- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
Except as required by Kan. Stat. Ann. § 59-606, and amendments thereto, with respect to testamentary trusts or Kan. Stat. Ann. §§ 33-105, 33-106 and 58-2401, and amendments thereto, a trust need not be evidenced by a trust instrument, but the creation of an oral trust and its terms may be established only by clear and convincing evidence.
