Terms Used In Kansas Statutes 72-6134

  • Air gun: means any device which will or is designed to or may be readily converted to, expel a projectile by the release of compressed air or gas, and which is of 0. See Kansas Statutes 72-6131
  • Organization: means any profit or nonprofit association, whether school-sponsored or community-based, whose primary purpose is to provide youth development by engaging individuals under the age of 18 in activities designed to promote and encourage self-confidence, teamwork and a sense of community. See Kansas Statutes 72-6131
  • Property: includes personal and real property. See Kansas Statutes 77-201
  • School: means a public school or an accredited nonpublic school. See Kansas Statutes 72-6131

(a) No school district shall adopt a policy that prohibits an organization from conducting activities on school property solely because such activities include the possession and use of air guns by the participants. Any policy adopted pursuant to Kan. Stat. Ann. § 72-6132, and amendments thereto, shall not prohibit the possession of an air gun by a pupil on school property if such pupil is a participant in the activities of an organization.

(b) A policy adopted pursuant to Kan. Stat. Ann. § 72-6132, and amendments thereto, may prohibit the possession of air guns by pupils at school, on school property or at a school supervised activity, except when a pupil is participating in activities conducted by an organization, or is in transit to or from such activities.

(c) Any individual desiring to participate in activities conducted by an organization may be required to sign, or have a parent or legal guardian sign, a liability waiver. The liability waiver shall be in such form as prescribed by the chief administrative officer of the school and shall contain the appropriate language so as to relieve the school district, the school and all school personnel from liability for any claims arising out of the acts or omissions of any individual or any school personnel relating to activities conducted by an organization.

(d) The provisions of this section shall be a part of and supplemental to Kan. Stat. Ann. § 72-6131 et seq., and amendments thereto.
