Terms Used In Kansas Statutes 72-6494
- board of education: means the board of education of any school district. See Kansas Statutes 72-6486
- Bus: means every motor vehicle, as defined in Kan. See Kansas Statutes 72-6486
- School district: means any unified school district organized and operating under the laws of this state. See Kansas Statutes 72-6486
(a) The board of education of a school district shall not furnish or provide transportation for students who reside in another school district except in accordance with the written consent of the board of education of the school district in which such student resides, or in accordance with an order issued by a board of education under the provisions of Kan. Stat. Ann. § 72-3124, and amendments thereto, or in accordance with the provisions of an agreement entered into under authority of Kan. Stat. Ann. § 72-13,101, and amendments thereto.
(b) A school district may transport a nonresident student if such student boards the school bus within the boundaries or on the boundary of the transporting school district. To the extent that the provisions of this subsection conflict with the provisions of subsection (a), the provisions of subsection (a) shall control.
(c) No student who is furnished or provided transportation by a school district that is not the school district in which the student resides shall be counted in the computation of the school district’s transportation weighting under the Kansas school equity and enhancement act, Kan. Stat. Ann. § 72-5131 et seq., and amendments thereto.
