A public official charged with the enforcement of any state, county or municipal building code shall not accept or approve any technical submissions involving the practice of the technical professions unless the technical submissions have been stamped with the technical professional’s seal, signed and dated as required by Kan. Stat. Ann. § 74-7001 et seq., and amendments thereto, or unless the applicant has certified on the technical submission to the applicability of a specific exception provided for in Kan. Stat. Ann. § 74-7035, and amendments thereto, permitting the preparation of the technical submissions by a person not licensed under Kan. Stat. Ann. § 74-7001 et seq., and amendments thereto. A building permit issued with respect to technical submissions which does not conform to the requirements of Kan. Stat. Ann. § 74-7001 et seq., and amendments thereto, is invalid. The acceptance or approval of technical submissions or the issuance of a building permit by a public official engaged in building inspection responsibilities, contrary to the provisions of Kan. Stat. Ann. § 74-7001 et seq., and amendments thereto, shall not create liability upon the public official or the official’s governmental agency.
