Terms Used In Kansas Statutes 8-1006
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
(a) The provisions of Kan. Stat. Ann. § 8-1005, and amendments thereto, shall not be construed as limiting the introduction of any other competent evidence bearing upon the question of whether or not the defendant was under the influence of alcohol or drugs, or both.
(b) Nothing in this act shall require any samples of blood, breath or urine to be preserved for or furnished to the person for independent testing.
