Terms Used In Kansas Statutes 8-2411

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Director: means the director of vehicles, or a designee of the director. See Kansas Statutes 8-2401
  • Licensee: means any person issued a valid license pursuant to this act. See Kansas Statutes 8-2401
  • Person: means any natural person, partnership, firm, corporation or association. See Kansas Statutes 8-2401

(a) When any licensee is found to be allegedly violating any of the applicable provisions of this act, or any order or rule and regulation adopted pursuant thereto, the director upon the director’s own motion or upon complaint may commence a hearing against the licensee, which hearing shall be conducted in accordance with the provisions of the Kansas administrative procedure act.

(b) Any person who is found to have violated any applicable provisions of this act, any rule and regulation adopted pursuant thereto or any applicable order of the director shall be subject to a civil penalty of not less than $50 nor more than $1,000 for each violation or such person’s license may be suspended or revoked or both civil penalty and license suspension or revocation, except that in addition to any civil penalty imposed pursuant to this subsection, the director shall suspend or revoke the license of any person who is found to have violated the provisions of Kan. Stat. Ann. § 79-3601 et seq., and amendments thereto, by the failure to file returns and remit sales tax as required pursuant to Kan. Stat. Ann. § 79-3607, and amendments thereto, or the provisions of Kan. Stat. Ann. § 79-3294 et seq., and amendments thereto, by the failure to file returns and remit withholding tax as required pursuant to Kan. Stat. Ann. § 79-3298, and amendments thereto, for three consecutive months.

(c) Any party aggrieved by the decision of the director may appeal the same to the district court in accordance with the provisions of the Kansas judicial review act.
