Any county or waste management district may require the use of any solid waste management facility or other facility, meeting the standards of the department set by regulations issued pursuant to KRS Chapter 224 by all persons situated within the geographical boundaries thereof; such mandatory use of any solid waste management facility shall not be applicable to any city within the geographical boundaries of any such county or waste management district provided that:
(1) The city owns and operates a municipal solid waste management facility; and
(2) The solid waste management facility is not a sanitary landfill; and
(3) The solid waste management facility was in existence prior to June 17, 1978; and
(4) The solid waste management facility complies with the intent and purposes of KRS Chapters 109 and 224.

(1) The city owns and operates a municipal solid waste management facility; and

- City: means an existing city of any class. See Kentucky Statutes 109.012
- Municipal solid waste: means household solid waste and commercial solid waste. See Kentucky Statutes 109.012
- Solid waste: means any garbage, refuse, sludge, and other discarded material, including solid, liquid, semisolid, or contained gaseous material resulting from industrial, commercial, mining (excluding coal mining waste, coal mining by-
products, refuse and overburden), agricultural operations, and from community activities, but does not include those materials including but not limited to sand, soil, rock, gravel, or bridge debris extracted as part of a public road construction project funded wholly or in part with state funds, recovered material, post-use polymers or recovered feedstocks as those terms are defined in KRS §. See Kentucky Statutes 109.012 - Waste management district: means any county or group of counties electing to form under the provisions of KRS §. See Kentucky Statutes 109.012
(2) The solid waste management facility is not a sanitary landfill; and
(3) The solid waste management facility was in existence prior to June 17, 1978; and
(4) The solid waste management facility complies with the intent and purposes of KRS Chapters 109 and 224.
