Any trap set, used, or maintained in violation of the provisions of KRS § 150.400 or
150.410 shall be subject to confiscation as contraband under the provisions of KRS
150.120, except that any trap set, used, or maintained without the tag required by subsection (1) of KRS § 150.410 is hereby declared contraband and shall be so treated without any order of court so declaring.
