Any lot of pesticide not in compliance with the provisions of KRS § 217.542 to KRS § 217.630 shall be subject to seizure on complaint of the department to a court of competent jurisdiction in the county in which said pesticide is located. In the event the court finds the said pesticide to be in violation of KRS § 217.542 to KRS § 217.630 and orders the condemnation of said pesticide it shall be disposed of in any manner consistent with the quality of the pesticide and the laws of the state; provided, that in no instance shall the disposition of said pesticide be ordered by the court without first giving the claimant an opportunity to apply to the court for release of said pesticide for permission to reprocess or relabel said product to bring it into compliance with KRS § 217.542 to KRS § 217.630.

  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
