No person suffering from substance use disorder shall be ordered to undergo treatment unless that person:
(1) Suffers from substance use disorder;
(2) Presents an imminent threat of danger to self, family, or others as a result of a substance use disorder, or there exists a substantial likelihood of such a threat in the near future; and
(3) Can reasonably benefit from treatment.

(1) Suffers from substance use disorder;
Terms Used In Kentucky Statutes 222.431
- Substance use disorder: means a cluster of cognitive, behavioral, and physiological symptoms indicating that the individual continues using the substance despite significant substance-related problems. See Kentucky Statutes 222.005
- Treatment: includes those services provided by the cabinet in KRS §. See Kentucky Statutes 222.005
(2) Presents an imminent threat of danger to self, family, or others as a result of a substance use disorder, or there exists a substantial likelihood of such a threat in the near future; and
(3) Can reasonably benefit from treatment.
