Exclusive venue for any appeal of a violation, determination, finding of noncompliance, or any other action of the Finance and Administration Cabinet, Energy and Environment Cabinet, or other state agency relating to any county, urban-county, charter county, consolidated local government, city, special district, or other governmental unit specified in this subchapter and KRS § 30A.190, 109.011, 109.041, 109.0415, 224A.011, 224A.100,
431.100, 433.753, 433.757, and 512.070 shall be in the court of competent jurisdiction of the county which is the subject of the action by the state agency.

Terms Used In Kentucky Statutes 224.43-090

  • Action: includes all proceedings in any court of this state. See Kentucky Statutes 446.010
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Cabinet: means the Energy and Environment Cabinet. See Kentucky Statutes 224.1-010
  • City: includes town. See Kentucky Statutes 446.010
  • District: means an air pollution control district as provided for in KRS Chapter 77. See Kentucky Statutes 224.1-010
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • State: when applied to a part of the United States, includes territories, outlying possessions, and the District of Columbia. See Kentucky Statutes 446.010
  • Venue: The geographical location in which a case is tried.
