(1) Retail sellers of new lead acid batteries shall:
(a) Accept, if offered, used lead acid batteries, but the seller shall be required to accept only one (1) used battery for each new battery sold; and

Terms Used In Kentucky Statutes 224.50-413

  • Recycling: means any process by which materials which would otherwise become solid waste are collected, separated, or processed and reused or returned to use in the form of raw materials or products, including refuse-derived fuel when processed in accordance with administrative regulations established by the cabinet, but does not include the incineration or combustion of materials for the recovery of energy. See Kentucky Statutes 224.1-010

(b) Post notice at the place of retail sales that they are required to accept, if offered, a used lead acid battery for each new battery sold.
(2) Wholesale sellers of new lead acid batteries shall:
(a) Accept used lead acid batteries of the same type as the new batteries sold and in a quantity equal to the number of new batteries sold; and
(b) Remove used lead acid batteries from the retailer’s place of business no later than ninety (90) days after the retailer notifies the wholesaler that there are used lead acid batteries ready for recycling.
