Terms Used In Kentucky Statutes 309.422

  • State: when applied to a part of the United States, includes territories, outlying possessions, and the District of Columbia. See Kentucky Statutes 446.010
  • Statute: A law passed by a legislature.

Effective: July 15, 2016
History: Repealed, reenacted, renumbered, and amended 2016 Ky. Acts ch. 103, sec.
10, effective July 15, 2016. — Created 2012 Ky. Acts ch. 73, sec. 8, effective July 12,
2012.
Legislative Research Commission Note (7/15/2016). Subsection (1) of 2016 Ky. Acts ch. 103, sec. 10 (this statute) reads in part “…who is required to be licensed under Section 5 or 7 of this Act…” Section 5 of that Act was KRS § 309.414, which prescribes the process for applying for a license as a home medical equipment and services provider, and Section 7 of that Act was KRS § 309.420, which provides license reciprocity in Kentucky for providers licensed in another state. However, it was Section 3 of that Act, KRS § 309.412, that contains the requirement that a person providing home medical equipment and services be licensed. Therefore, Section 3 should have been referred to instead of Section 5. In codifying 2016 Ky. Acts ch.
103, sec. 10, the Reviser of Statutes has changed the citation as codified in subsection
(1) of this statute to read in part “…who is required to be licensed under KRS
309.412 or 309.420 …” to correct this manifest clerical or typographical error under the authority of KRS § 7.136(1)(h).
Formerly codified as KRS § 315.524.
