(1) This chapter does not prohibit:
(a) The performance of respiratory care which is an integral part of the program of study by students enrolled in an accredited program;

Terms Used In Kentucky Statutes 314A.105

  • respiratory care practitioner: includes the following:
    (a) A "registered respiratory therapist" means an individual who has successfully completed a training program accredited by the American Medical Association's Commission on Accreditation of Allied Health Education or its equivalent in collaboration with the Committee on Accreditation for Respiratory Care or its equivalent, and who has successfully completed the registry examination for advanced respiratory therapists administered by the National Board for Respiratory Care, Incorporated or its equivalent. See Kentucky Statutes 314A.010

(b) Self-care by the patient nor the gratuitous care by a friend or member of the family who does not represent or hold himself out to be a respiratory care practitioner;
(c) Respiratory care services provided in the case of an emergency; (d) Persons from engaging in cardiopulmonary research;
(e) The performance of respiratory care by trained paramedical personnel; and
(f) Volunteer health practitioners providing services under KRS § 39A.350 to
39A.366.
(2) Nothing in this section shall limit, preclude, or otherwise restrict the practices of other licensed personnel in carrying out their duties under the terms of their license.
