Kentucky Statutes 76.295 – Certificate of noninterference by metropolitan sewer district required before petition for sewer construction district

In counties containing a metropolitan sewer district, the county judge/executive shall not accept for filing a petition tendered to it pursuant to KRS § 76.300 to KRS § 76.305 unless the metropolitan sewer district has certified in a written instrument that the proposed sewer construction district will not interfere with the orderly operation and expansion of the metropolitan sewer district. The Circuit Court of any county containing a metropolitan sewer district shall have jurisdiction to compel by injunction the issuing of such a certificate if its issuance has been denied arbitrarily, capriciously, or unreasonably.
