(1) Where there has been an overpayment of any tax imposed under KRS § 141.020,
141.310, or 141.315, the amount of such overpayment shall be credited against any income tax or installment thereof then due from the taxpayer, and any balance shall be refunded in the manner provided in KRS § 141.235.
(2) Where the amount of the tax withheld at the source under KRS § 141.310 or 141.315 exceeds the taxes imposed by KRS § 141.020 against which the tax so withheld may be credited under KRS § 141.350, the amount of such excess shall be considered an overpayment.
