(1) If a child is receiving services under Part D of Title IV of the Social Security Act and the cabinet has taken action under the provisions of KRS § 205.715 to KRS § 205.800,
403.215, 405.405 to 405.530 and 530.050 to obtain support on behalf of the child, matters concerning custody of the child and visitation rights of the parents shall not be used by either parent as a reason not to pay child support to the cabinet.

Terms Used In Kentucky Statutes 205.770

  • Action: includes all proceedings in any court of this state. See Kentucky Statutes 446.010
  • Cabinet: means the Cabinet for Health and Family Services. See Kentucky Statutes 205.010
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

(2) Upon a determination by the cabinet that such would be in the best interest of the child, the cabinet may petition a Circuit Court of proper jurisdiction in the name of the child to make a determination of child custody and visitation rights of a parent.
