KRS § 224.80-100 to KRS § 224.80-210 shall not be construed to authorize a use of real property that is otherwise prohibited by zoning, by law other than is prescribed for the regulating of real property in KRS § 224.80-100 to KRS § 224.80-210, or by a recorded instrument that has priority over the environmental covenant. An environmental covenant may prohibit or restrict uses of real property authorized by zoning or by law that are not prescribed in KRS § 224.80-100 to KRS § 224.80-210.

- Environmental covenant: means a servitude arising under an environmental response project that imposes activity and use limitations. See Kentucky Statutes 224.80-100
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
