In order to promote economic development and tourism, other provisions of the Kentucky Revised Statutes notwithstanding, the department may issue an NQ1 retail drink license under KRS § 243.030 to a horse racetrack that is licensed under KRS § 230.300 and is located in a wet or moist city under KRS § 242.1238. The license issued under this section shall be in effect only for horse racetrack premises where live racing meets were held in
2006. Nothing in this section shall be construed as authorizing the issuance of any alcoholic beverage license on any part of the horse race track’s premises that is located outside the city’s limits.
