Upon the filing with the State Board of Agriculture of the application on the part of any commission, council, board, association, or other agency of producers, the Commissioner shall within thirty (30) days thereafter convene the State Board of Agriculture to consider the application; and if upon the consideration the Board of Agriculture shall find that the commission, council, board, or other agency making the application is fairly representative of and has been duly chosen and delegated as representative of the producers producing the commodity, and shall otherwise find and determine that the application is in conformity with the provisions of KRS § 247.4451 to KRS § 247.4483 and the purposes stated, then it shall be the duty of the Commissioner of Agriculture to certify the commission, council, board, association, or other agency as the duly delegated and authorized group or agency representative of the producers of the agricultural commodity, and shall likewise certify that the agency is duly authorized to conduct among the producers of the commodity a referendum for the purpose stated.
