(1) The commissioner shall promulgate administrative regulations pursuant to KRS Chapter 13A:
(a) Establishing the form and content of a statement for services;

Terms Used In Kentucky Statutes 342.734

  • Board: means the Workers' Compensation Board. See Kentucky Statutes 342.0011
  • Commissioner: means the commissioner of the Department of Workers' Claims under the direction and supervision of the secretary of the Education and Labor Cabinet. See Kentucky Statutes 342.0011
  • Compensation: means all payments made under the provisions of this chapter representing the sum of income benefits and medical and related benefits. See Kentucky Statutes 342.0011
  • Medical services: means medical, surgical, dental, hospital, nursing, and medical rehabilitation services, medicines, and fittings for artificial or prosthetic devices. See Kentucky Statutes 342.0011

(b) Specifying the manner in which the employee may designate and change the designation of physicians;
(c) Requiring selection of gatekeeper physicians;
(d) Requiring reports from providers on the condition of the employee; and
(e) Establishing procedures by which disputes relative to the necessity, effectiveness, frequency, and cost of medical services shall be resolved.
(2) Pending the effective date of administrative regulations promulgated by the commissioner, all administrative regulations heretofore promulgated by the Workers’ Compensation Board pertaining to these matters shall remain in effect, it being determined that those administrative regulations are within the statutory grant of authority, meet legislative intent, and are not in conflict with the provisions of this chapter.
