(1) In addition to pursuing any other remedy, anyone who is a victim under KRS
434.872, 434.874, 514.160, or 514.170, shall have a cause of action, either where the victim resides or the defendant resides, for compensatory and punitive damages against anyone who violates KRS § 434.872, 434.874, 514.160, or 514.170 and, if successful, shall be awarded reasonable costs and attorneys’ fees.
(2) The statute of limitations for cases under the provisions of this section shall be five
(5) years from the date of the discovery of the violation of KRS § 434.872, 434.874,
514.160, or 514.170.

- Action: includes all proceedings in any court of this state. See Kentucky Statutes 446.010
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
