(1) A person is guilty of unlawful assembly when:
(a) He assembles with five (5) or more persons for the purpose of engaging or preparing to engage with them in a riot; or

(b) Being present at an assembly which either has or develops such a purpose, he remains there with intent to advance that purpose.
(2) Unlawful assembly is a Class B misdemeanor.

Terms Used In Kentucky Statutes 525.050
- Riot: means a public disturbance involving an assemblage of five (5) or more persons which by tumultuous and violent conduct creates grave danger of damage or injury to property or persons or substantially obstructs law enforcement or other government function. See Kentucky Statutes 525.010
(b) Being present at an assembly which either has or develops such a purpose, he remains there with intent to advance that purpose.
(2) Unlawful assembly is a Class B misdemeanor.
