  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Adjusted gross receipts: means gross receipts less all cash prizes and the amount paid for merchandise prizes purchased. See Kentucky Statutes 238.505
  • Administrative regulation: means an administrative regulation adopted by the department and filed and approved in accordance with KRS Chapter 13A that is designed to ensure the safety of boilers and pressure vessels that affects or may affect property rights of a designated class of owners, or designed for the prevention of loss or damage to property, loss of life, or personal injury from boiler or pressure vessel explosion or from certain indicated hazards related thereto.   • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affiliate: means any corporation, partnership, association, or other business or professional entity or any natural person that directly or indirectly, through one or more intermediaries, controls, or is controlled by, or is under common control with a licensed manufacturer, distributor, or charitable gaming facility.   • Agriculture: means the business of raising or producing:
    (a) Crops, the products of which are used for food, feed, fiber, energy, or pharmaceuticals. See Kentucky Statutes 246.010
  • Allegation: something that someone says happened.
  • Animal: includes every warm-blooded living creature except a human being. See Kentucky Statutes 446.010
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • any other state: includes any state, territory, outlying possession, the District of Columbia, and any foreign government or country. See Kentucky Statutes 446.010
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appraisal: A determination of property value.
  • Approved company: means an eligible company approved under KRS §. See Kentucky Statutes 154.34-010
  • Approved costs: means the eligible equipment and related costs approved by the authority that may be recovered by an approved company through the incentives authorized by this subchapter. See Kentucky Statutes 154.34-010
  • Aquaculture: means the science, art, and business of producing and raising aquatic organisms under controlled or semicontrolled conditions. See Kentucky Statutes 246.010
  • Arrest: Taking physical custody of a person by lawful authority.
  • ASME: means American Society of Mechanical Engineers. See Kentucky Statutes 236.010
  • Attorney: means attorney-at-law. See Kentucky Statutes 446.010
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Bequest: Property gifted by will.
  • Biennium: means the two (2) year period commencing on July 1 in each even- numbered year and ending on June 30 in the ensuing even-numbered year. See Kentucky Statutes 446.010
  • Bingo: means a specific game of chance in which participants use cards or paper sheets, or card-minding device representations thereof, divided into horizontal and vertical spaces, each of which is designated by a letter and a number, and prizes are awarded on the basis of the letters and numbers on the card conforming to a predetermined and preannounced configuration of letters and numbers selected at random. See Kentucky Statutes 238.505

  • boilers: means and includes a closed vessel in which water or other liquid is heated, steam or vapor is generated, steam is superheated, or in which any combination of these functions is accomplished, under pressure or vacuum, for use externally to itself, by the direct application of energy from the combustion of fuels, or from electricity, solar or nuclear energy.   • branch budget: means an enactment by the General Assembly which provides appropriations and establishes fiscal policies and conditions for the biennial financial plan for the judicial branch, the legislative branch, and the executive branch, which shall include a separate budget bill for the Transportation Cabinet. See Kentucky Statutes 446.010
  • Brand: means a permanent identification mark of which the letters, numbers and figures used are each three (3) inches or more in length or diameter and are humanly burned into the hide of a live animal with a hot iron or tattoo or caustic chemical substance and is to be considered in relation to its location on the animal and the term relates to both the mark and location. See Kentucky Statutes 253.010
  • Cabinet: means the Tourism, Arts and Heritage Cabinet. See Kentucky Statutes 235.010
  • Cabinet: means the Cabinet for Economic Development. See Kentucky Statutes 154.35-010
  • Capital offense: A crime punishable by death.
  • Card-minding device: means any mechanical, electronic, electromechanical, or computerized device that is interfaced with or connected to equipment used to conduct a game of bingo and that allows a player to store, display, and mark a bingo card face. See Kentucky Statutes 238.505
  • Center: means either or both of the following as the context requires:
    (a) "Basic research centers" which means centers under contract with the
    University of Kentucky and the University of Louisville. See Kentucky Statutes 154.35-010
  • Certificate inspection: means an inspection, the report of which is used by the chief boiler inspector to determine whether or not a certificate, as provided by subsection (1) of KRS §. See Kentucky Statutes 236.010
  • Certified mail: means any method of governmental, commercial, or electronic delivery that allows a document or package to have proof of:
    (a) Sending the document or package. See Kentucky Statutes 446.010
  • Chairperson: means the chief executive officer and any officer, member, or employee of a licensed charitable organization who will be involved in the management and supervision of charitable gaming as designated in the organization's charitable gaming license application under KRS §. See Kentucky Statutes 238.505
  • Charitable gaming: means bingo, charity game tickets, raffles, and charity fundraising events conducted for fundraising purposes by charitable organizations licensed and regulated under the provisions of this chapter. See Kentucky Statutes 238.505
  • Charitable gaming facility: means the premises on which charitable gaming is conducted. See Kentucky Statutes 238.505
  • Charitable gaming supplies and equipment: means any material, device, apparatus, or paraphernalia customarily used in the conduct of charitable gaming, including bingo cards and paper, charity game tickets, and other apparatus or paraphernalia used in conducting games of chance at charity fundraising events subject to regulation under this chapter. See Kentucky Statutes 238.505
  • Charitable organization: means a nonprofit entity organized for charitable, religious, educational, literary, civic, fraternal, or patriotic purposes. See Kentucky Statutes 238.505
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Charity fundraising event: means an activity of limited duration at which games of chance approved by the department are conducted, including bingo, raffles, charity game tickets, special limited charitable games, and wagering on prerecorded horse races, KRS Chapter 230 notwithstanding. See Kentucky Statutes 238.505
  • Charity game ticket: means a game of chance using a folded or banded paper ticket, or a paper card with perforated break-open tabs, or electronic pulltab device representations thereof, the face of which is covered or otherwise hidden from view to conceal a number, letter, symbol, or set of numbers, letters, or symbols, some of which have been designated in advance as prize winners and shall include charity game tickets that utilize a seal card. See Kentucky Statutes 238.505
  • Chief boiler inspector: means the person employed by the department who shall serve as the boiler section supervisor within the Division of Plumbing. See Kentucky Statutes 236.010
  • Claimant: means a person who:
    (a) Possesses scale tickets, settlement sheets, ledger cards, or other written evidence of ownership of fund-covered grain stored or possessed by a licensee. See Kentucky Statutes 251.010
  • Clerk: means county clerk. See Kentucky Statutes 235.010
  • Commission: means the Kentucky Livestock Care Standards Commission. See Kentucky Statutes 257.010
  • Commissioner: means the commissioner of the Department of Fish and

  • Contracting university: means any of the following that contract with the council to operate a center: the University of Kentucky, the University of Louisville, Eastern Kentucky University, Western Kentucky University, Morehead State University, Northern Kentucky University, Murray State University, and Kentucky State University.   • Conviction: A judgement of guilt against a criminal defendant.

  • Directors: when applied to corporations, includes managers or trustees. See Kentucky Statutes 446.010

  • Distributor: means a person who sells, markets, leases, or otherwise furnishes to a charitable organization charitable gaming equipment or supplies, or both, used in the conduct of charitable gaming. See Kentucky Statutes 238.505
  • Division: means the Division of Plumbing in the department. See Kentucky Statutes 236.010
  • Division of Law Enforcement: means the Division of Law Enforcement, Department of Fish and Wildlife Resources administratively attached to the Tourism, Arts and Heritage Cabinet. See Kentucky Statutes 235.010
  • Domestic animal: means any animal converted to domestic habitat. See Kentucky Statutes 446.010
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash.     prevention of:
    (a) Loss or damage to property. See Kentucky Statutes 236.010
  • Equipment: means manufacturing machinery equipment, computers, furnishings, fixtures, and other assets installed by the approved company as part of the reinvestment project. See Kentucky Statutes 154.34-010
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one.   • firm: means any individual, firm, partnership, or corporation. See Kentucky Statutes 236.010
  • Fish: means the bodies and parts of bodies of all animal aquatic life being raised, or kept for sale to a wholesaler or retailer, or for direct sale to the public. See Kentucky Statutes 257.010

  • Heating boiler: means a steam or vapor boiler operating at pressures not exceeding fifteen (15) pounds per square inch gauge or a hot water boiler operating at pressures not exceeding one hundred sixty (160) pounds per square inch gauge or temperatures not exceeding two hundred fifty (250) degrees Fahrenheit.   • Horticulture: means the business of raising fruits, nuts, vegetables, flowers, ornamental plants, shrubs, trees, herbs, and the starts or transplants needed to produce these items. See Kentucky Statutes 246.010
  • Immediate family: means :
    (a) Spouse and parents-in-law. See Kentucky Statutes 238.505
  • Incentives: means the Kentucky tax credit as prescribed in this subchapter. See Kentucky Statutes 154.34-010
  • Independent inspection agency: means a person or company licensed under KRS §. See Kentucky Statutes 236.010
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Infrastructure: means the Kentucky Research and Development Infrastructure. See Kentucky Statutes 154.35-010
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Insect: means any of the numerous small invertebrate animals generally having the body more or less obviously segmented, for the most part belonging to the class Insecta, comprising six (6) legged, usually winged forms, as for example, beetles, bugs, bees, wasps, flies, and other allied classes of arthropods whose members are wingless and usually have more than six (6) legs, as for example, spiders, mites, ticks, centipedes, and wood lice, and any other invertebrates which are destructive, constitute a liability, and may be classed as pests.   • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Key industry: means an industry or business within an industrial sector which has been identified in and targeted by the state's economic development strategic plan as having major importance to the sustained economic growth of the Commonwealth and in which member firms sell goods or services into markets for which national or international competition exists, including but not limited to secondary forest products manufacturing, agribusiness, and high technology and biotechnology manufacturing and services.   • Lawful fence: means :
    (a) A strong and sound fence, four (4) feet high, so close that cattle cannot creep through, made of rails, or plank, or wire and plank, or iron, or hedge, or stone or brick. See Kentucky Statutes 256.010
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Livestock: means cattle, sheep, swine, goats, horses, llamas, buffaloes, or any other animals of the bovine, ovine, porcine, caprine, or equine species, deer and elk, whose regulatory requirements are under KRS Chapters 150 and 246, that are privately owned and raised in a confined area for breeding stock, food, fiber, and other products.   • Marine sanitation device: means equipment that is identified by the United States Coast Guard as meeting the standards of the United States Environmental Protection Agency or that is approved by the Energy and Environment Cabinet, to eliminate the discharge of untreated sewage from vessels into the waters of the Commonwealth and is a device that receives, treats, retains, or discharges sewage. See Kentucky Statutes 235.010
  • Mark: means a permanent cut identification from the ear of a live animal. See Kentucky Statutes 253.010
  • MAWP: means the maximum allowable working pressure for a boiler, pressure vessel, or piping system. See Kentucky Statutes 236.010
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Motorboat: means any vessel propelled by machinery, whether or not such machinery is the principal source of propulsion, except for the following:
    (a) Boats or vessels propelled totally by a direct current battery-powered motor when used on private waters. See Kentucky Statutes 235.010
  • Net receipts: means adjusted gross receipts less all expenses, charges, fees, and deductions authorized under this chapter. See Kentucky Statutes 238.505
  • Nursery dealer: means any person or landscaper not a grower of nursery stock in this Commonwealth who:
    (a) Buys, sells, ships, or distributes nursery stock for commercial or monetary gain in the Commonwealth of Kentucky. See Kentucky Statutes 249.010
  • Nursery stock: means all field or container-grown and native trees, sod, shrubs, herbaceous perennials, vines, cuttings, grafts, scions, buds, fruit-pits, and other seeds of fruit and ornamental trees and shrubs. See Kentucky Statutes 249.010
  • Nurseryperson: means any person who owns, leases, manages, or is in charge of a nursery, and who propagates nursery stock. See Kentucky Statutes 249.010
  • Oath: A promise to tell the truth.
  • Operate: means to navigate or otherwise use a motorboat or a vessel. See Kentucky Statutes 235.010
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means a person, other than a lienholder, having the property in or title to a motorboat. See Kentucky Statutes 235.010
  • Owner: means any person owning or leasing from another, or having in charge any domestic animal. See Kentucky Statutes 257.010
  • Owner: when applied to any animal, means any person having a property interest in such animal. See Kentucky Statutes 446.010
  • Owner facility: means any facility licensed pursuant to KRS §. See Kentucky Statutes 236.010
  • Person: means an individual, partnership, firm, corporation, association, or
    other entity. See Kentucky Statutes 235.010
  • Person: means any individual, partnership, association, or any organized group of persons whether incorporated or not. See Kentucky Statutes 249.010
  • Person: means any individual, partnership, firm, corporation, limited liability company, or other corporate entity created under the laws of the Commonwealth or any other jurisdiction. See Kentucky Statutes 251.010
  • Personal watercraft: means a vessel which uses an internal combustion engine to power a jet pump for its primary source of propulsion and is designed to be operated by a person sitting, standing, or kneeling on the vessel rather than to be operated by a person sitting or standing inside the vessel. See Kentucky Statutes 235.010
  • Pest: means any insect, snail, slug, rodent, nematode, fungus, weed. See Kentucky Statutes 249.010
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plants and plant products: means any trees, shrubs, vines, forage and cereal plants, and fruit, vegetables, roots, bulbs, seeds, wood, lumber, and all other parts of plants or plant products. See Kentucky Statutes 249.010
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Potable water: means water free from impurities present in amounts sufficient to cause disease or harmful physiological effects and conforming in its bacteriological and chemical quality to the requirements of the Division of Water or the administrative regulations of the department. See Kentucky Statutes 236.010
  • Poultry: means chickens, ducks, turkeys, or other domestic fowl being raised or kept on any premises in the Commonwealth for profit. See Kentucky Statutes 246.010
  • Poultry: means chickens, ducks, turkeys, or other domestic fowl being raised or kept on any premises in the Commonwealth. See Kentucky Statutes 257.010
  • Power boiler: means a boiler in which steam or other vapor is generated at a pressure of more than fifteen (15) pounds per square inch gauge. See Kentucky Statutes 236.010
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Premises: means any portion of land, or any structure erected on land. See Kentucky Statutes 257.010
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Pressure vessel: means a vessel in which the pressure is obtained from an external source or by the application of heat other than those vessels defined in subsection (1) of this section. See Kentucky Statutes 236.010
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Producer: means the owner, tenant, or operator of land who has an economic or financial interest in grain or receives all or any part of the proceeds from the sale of grain. See Kentucky Statutes 251.010
  • Producer: means a person who cultivates or harvests hay or other agricultural products for sale. See Kentucky Statutes 260.010
  • public funds: means sums actually received in cash or negotiable instruments from all sources unless otherwise described by any state agency, state- owned corporation, university, department, cabinet, fiduciary for the benefit of any form of state organization, authority, board, bureau, interstate compact, commission, committee, conference, council, office, or any other form of organization whether or not the money has ever been paid into the Treasury and whether or not the money is still in the Treasury if the money is controlled by any form of state organization, except for those funds the management of which is to be reported to the Legislative Research Commission pursuant to KRS §. See Kentucky Statutes 446.010
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Quorum: The number of legislators that must be present to do business.
  • Raffle: means a game of chance in which a participant is required to purchase a ticket for a chance to win a prize, with the winner to be determined by a random drawing. See Kentucky Statutes 238.505
  • railroad: means the person who owns a right-of-way and owns or controls a railroad in this state that has been in operation for five (5) years. See Kentucky Statutes 256.010
  • Registered mail: means any governmental, commercial, or electronic method of delivery that allows a document or package to have:
    (a) Its chain of custody recorded in a register to enable its location to be tracked. See Kentucky Statutes 446.010
  • Regular election: means the election in even-numbered years at which members of Congress are elected and the election in odd-numbered years at which state officers are elected. See Kentucky Statutes 446.010
  • Reinvestment project: means :
    (a) A reinvestment in the facility of an eligible company and in the full-time employees of an eligible company through the acquisition, construction, and installation of new equipment and, with respect thereto, the construction, rehabilitation, and installation of improvements to facilities necessary to house the new equipment, including surveys. See Kentucky Statutes 154.34-010
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Reportable disease: means an animal disease that shall be reported to state or federal animal health officials when suspected or diagnosed. See Kentucky Statutes 257.010
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Safe boating certificate: means a document attesting the successful completion of instruction, approved by the department or given by the United States Coast Guard or Coast Guard Auxiliary or the United States Power Squadron, to prepare an individual to safely operate a motorboat or personal watercraft on the waters of the Commonwealth. See Kentucky Statutes 235.010
  • Seal card: means a board or placard used in conjunction with charity game tickets, that contains a seal or seals which, when removed or opened, reveal predesignated winning numbers, letters, or symbols. See Kentucky Statutes 238.505
  • Secondary wood products industry: means businesses that compose that segment of the forest products industry that manufacture, assemble, process, or produce wood into a finished or semifinished product. See Kentucky Statutes 154.47-005
  • Secretary: means the secretary of the Public Protection Cabinet. See Kentucky Statutes 238.505
  • Secretary: means the secretary of the Cabinet for Economic Development. See Kentucky Statutes 154.35-010
  • Seed: means grain that is set aside to be used for the purpose of producing new plants. See Kentucky Statutes 251.010
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Society for the Prevention of Cruelty to Animals: means any nonprofit corporation, organized under the laws of this state and having as its primary purpose the prevention of cruelty to animals. See Kentucky Statutes 446.010
  • Special boiler inspector: means any person employed by an insurance company authorized to insure boilers and pressure vessels in the Commonwealth and who holds a commission as provided in KRS §. See Kentucky Statutes 236.010
  • Special limited charitable game: means roulette. See Kentucky Statutes 238.505
  • Stray cattle: means any animal of the bovine, ovine, porcine, or caprine species for which the owner is no longer claiming ownership or for which the owner cannot be determined, but not including any member of the equine species. See Kentucky Statutes 259.105
  • Stray equine: means any animal of the equine species for which the owner is no longer claiming ownership or for which the owner cannot be determined. See Kentucky Statutes 259.105
  • Subpoena: A command to a witness to appear and give testimony.
  • Summons: Another word for subpoena used by the criminal justice system.
  • Sworn: includes "affirmed" in all cases in which an affirmation may be substituted for an oath. See Kentucky Statutes 446.010
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Title: means the certificate of title. See Kentucky Statutes 235.010
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Venue: The geographical location in which a case is tried.
  • Vessel: means every description of watercraft, other than a seaplane on the water. See Kentucky Statutes 235.010
  • Violate: includes failure to comply with. See Kentucky Statutes 446.010
  • Warehouse: means any tobacco warehouse operating as a place of sale for tobacco in this state. See Kentucky Statutes 248.010
  • Warehouse: means any building, structure, or other protected enclosure, permanent or temporary, used or useable for the storage or conditioning of grain. See Kentucky Statutes 251.010
  • Warehouse receipt: means a document of title issued by a person engaged in the business of storing grains for compensation. See Kentucky Statutes 251.010
  • Warehouseman: means the owner, operator, manager, lessee or proprietor of a warehouse engaged in selling tobacco or his agents or employees. See Kentucky Statutes 248.010
  • Waters of this state: means any waters within the territorial limits of this state. See Kentucky Statutes 235.010
  • Weed: means any plant which grows where not wanted. See Kentucky Statutes 249.010
  • Weed seeds: means all seeds that are not agricultural, vegetable, or flower seeds. See Kentucky Statutes 250.010
  • Year: means calendar year except as used in subsection (11) of this section and KRS §. See Kentucky Statutes 238.505
