Terms Used In Louisiana Revised Statutes 9:398

  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Verdict: The decision of a petit jury or a judge.

This part shall apply to criminal cases subject to the following limitations and provisions:

(1)  An order for the tests shall be made only upon application of a party or on the court’s initiative;

(2)  The compensation of the experts shall be paid by the parish of the party’s domicile under order of court;

(3)  The court may direct a verdict of acquittal upon the conclusions of all the experts under the provisions of La. Rev. Stat. 9:397.3(D), otherwise the case shall be submitted for determination upon all the evidence.
