Whenever the surety tendered upon any indemnity bond, to be given as provided in La. Rev. Stat. 13:3872, shall reside out of the parish in which the mesne or final process is to be executed, the solvency or sufficiency of such surety shall be approved of by a judge of the district or by the recorder of the parish within which the surety resides.
