Louisiana Revised Statutes 28:146 – Expenses incident to discharge, removal, or funeral
Terms Used In Louisiana Revised Statutes 28:146
- Department: means the Louisiana Department of Health. See Louisiana Revised Statutes 28:2
- Discharge: means the full or conditional release from a treatment facility of any person admitted or otherwise detained under this Chapter. See Louisiana Revised Statutes 28:2
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Patient: means any person detained and taken care of as a person who has a mental illness or person who is suffering from a substance-related or addictive disorder. See Louisiana Revised Statutes 28:2
- State psychiatric hospital: means a public, state-owned and operated inpatient facility for the treatment of mental illness and substance-related and addictive disorders. See Louisiana Revised Statutes 28:2
A. If financially able, the patient or his legal guardian shall pay the costs of the patient’s funeral or his discharge and removal, including traveling expenses to his home; otherwise the state psychiatric hospital shall pay these costs. If discharge is ordered by the department and the state psychiatric hospital pays the patient’s traveling expenses to his home, the department shall reimburse the state psychiatric hospital out of appropriations for persons who are indigent and have a mental illness.
B. If a patient committed in accordance with La. Rev. Stat. 28:59 is ordered returned by the court, the parish in which the court is located shall pay these costs.
