A. No person shall offer or accept for transportation, load or unload, or transport a hazardous waste or hazardous material as defined in La. Rev. Stat. 32:1502, in a criminally negligent or reckless manner that could endanger human life or health.
B. Any person who willfully violates this Section shall, upon conviction, be guilty of a felony and be fined or imprisoned in accordance with La. Rev. Stat. 32:1514(B) or may be subject to a civil penalty in accordance with La. Rev. Stat. 32:1512(A).
C.(1) The department may revoke the “H”- hazardous materials endorsement issued pursuant to the provisions of La. Rev. Stat. 32:408(B)(3)(d) or the “X”- combination tank vehicle and hazardous materials endorsement issued pursuant to the provisions of La. Rev. Stat. 32:408(B)(3)(e), or both, on the commercial driver’s license of any person upon a final judgment of conviction or assessment of a civil penalty for a second or subsequent violation of this Section, if the material transported when the violation occurred met the definition of a hazardous material, as defined by La. Rev. Stat. 30:2363.
(2) The department may consider any prior final judgment of conviction or assessment of a civil penalty under this Section to determine whether or not to revoke an “H” or “X” endorsement on a commercial driver’s license.
