Terms Used In Louisiana Revised Statutes 33:130.865

  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.

            The district, acting by and through its board, shall have and exercise all powers of a political subdivision necessary or convenient for the carrying out of its objects and purposes, including but not limited to the following in addition to the other rights and powers set out in this Subpart:

            (1) To sue and be sued.

            (2) To adopt, use, and alter at will a corporate seal.

            (3) To acquire by gift, grant, or purchase all property, including rights-of-way and to hold and use any franchise or property, immovable, movable, mixed, corporeal, or incorporeal, or any interest therein, necessary or desirable for carrying out the objects and purposes of the district.

            (4) To enter into contracts for the purchase, lease, acquisition, construction, and improvement of works and facilities necessary in connection with the purposes of the district and to mortgage its properties and enter into leases and other agreements on terms the board approves. Any lease or sublease, including any assignment, extension, or renewal thereof, shall be exempt from the provisions of La. Rev. Stat. 38:2211 et seq. and any other provision of law with respect to the lease or sublease of property by public entities.

            (5) To require and issue licenses with respect to properties and facilities owned by the district.

            (6) To regulate the imposition of fees and rentals charged by the district for its facilities leased, operated, or owned and services rendered by it.

            (7) To appoint agents and employees, prescribe their duties, and fix their compensation.

            (8) To enter into cooperative endeavor agreements with any other party, public or private, to accomplish the purposes of this Subpart and to expend its funding within and without the territorial boundaries of the district to accomplish its purpose.

            (9) To exercise any and all of the powers granted to an economic development district as if the district were an economic development district established pursuant to Part II of Chapter 27 of Title 33 of the Louisiana Revised Statutes of 1950. The taxing authority granted to the district by this Paragraph shall not limit any taxing authority granted to the city of New Orleans pursuant to La. Const. Art. VI, § 29(B) .

            (10)(a) To create subdistricts as provided in this Paragraph. The district shall publish notice of its intent to create a subdistrict in the official journal of the district. At least ten days after publication of such notice in the official journal of the district, the board shall conduct a public hearing on the question of creating the subdistrict. Thereafter, the board may designate one or more proposed areas within the boundaries of the district as a subdistrict of the district.

            (b) Each subdistrict shall constitute a political subdivision of the state and shall be governed by the board. Each subdistrict shall have the same powers granted to the district, including the powers granted to the district pursuant to Paragraph (9) of this Section. Each subdistrict shall be given a name and designated as “New Orleans Exhibition Hall Authority Economic Growth and Development District Subdistrict No._____” or such other suitable name as the board may designate.
