Louisiana Revised Statutes 36:209 – Transfer of boards, commissions, departments, and agencies to Department of Culture, Recreation and Tourism
Terms Used In Louisiana Revised Statutes 36:209
- Agency: means and includes the boards, commissions, departments, agencies, offices, officers, and other instrumentalities, or any or all of these, within the executive branch of state government which are abolished by this Title or which are transferred and placed within departments of the state government created and established or continued by this Title or transferred to and placed within the office of the governor as provided by this Title. See Louisiana Revised Statutes 36:3
- Assistant secretary: means the officer designated by law or by the secretary of each department to carry out the duties and functions of an office within certain departments, except an office of management and finance and the office of state police of the Department of Public Safety and Corrections. See Louisiana Revised Statutes 36:3
- Office: means each principal operational unit within a department, except the executive office of the secretary. See Louisiana Revised Statutes 36:3
- Secretary: means the officer appointed by the governor as the executive head and chief administrative officer of certain departments created and provided for by this Title. See Louisiana Revised Statutes 36:3
A. The following agencies are transferred to and hereafter shall be within the Department of Culture, Recreation and Tourism in accordance with the provisions of La. Rev. Stat. 36:901 et seq. except as otherwise provided by this Subsection:
(1) Louisiana Archaeological Survey and Antiquities Commission (La. Rev. Stat. 41:1601 et seq.).
(2) State Parks and Recreation Commission (La. Rev. Stat. 56:1681 et seq.).
(3) The Board of Directors of the Louisiana State Museum (La. Rev. Stat. 25:341 et seq.). The board shall continue to exercise those powers, duties, and functions with respect to accessions, deaccessions, loans, and conservation of the buildings, collections, and exhibitions of the Louisiana State Museum which it is authorized by law to exercise, all in accordance with professional museum practices as established by the American Association of Museums, except as otherwise provided by law; and the members of the board shall continue to serve as trustees for the William Irby Trust.
(4) The board of commissioners of the State Library of Louisiana (La. Rev. Stat. 25:2 et seq.). The board shall continue to select the state librarian in accordance with law.
(5) The Louisiana State Arts Council (La. Rev. Stat. 25:891 et seq.). The council shall have authority to approve or disapprove the awarding of grants pursuant to applications submitted to the department for funding from funds made available from the National Endowment for the Arts and such other funds as are made available to the council. The council shall further have the authority necessary to administer the juried Louisiana native crafts program, including the authority to appoint a crafts panel and to approve the use, and disallow the continued use, of the logo assuring the quality of a Louisiana craftperson’s craft, as further provided in La. Rev. Stat. 25:897 through 900.
(6) The Louisiana National Register Review Committee (La. Rev. Stat. 25:901 et seq.).
(7) The Louisiana Folklife Commission (La. Rev. Stat. 25:821 et seq.).
(8) The Louisiana Tourism Development Commission (La. Rev. Stat. 51:1251 et seq. and La. Rev. Stat. 48:271). The commission shall continue to exercise those powers, duties, and functions with respect to financial assistance to eligible tourist promotion agencies; it shall nominate applicants for the position of assistant secretary of the office of tourism for the governor’s consideration for appointment; it shall review and advise on the selection of promotions and advertising contracts; and it shall make recommendations to and approve the annual plan for tourism marketing, all as provided by law.
(9) The Louisiana Civil Rights Museum Advisory Board (La. Rev. Stat. 25:841 et seq.). The board shall exercise and perform its powers, duties, functions, and responsibilities in accordance with accepted standards of museum operations and practices as established by the American Association of Museums.
(10) The Louisiana Music Trail Commission (La. Rev. Stat. 56:1950.23).
B. The following agencies are hereby abolished and their powers, duties, functions, and responsibilities are transferred to the secretary of the Department of Culture, Recreation and Tourism and hereafter shall be exercised and performed as provided in La. Rev. Stat. 36:921 et seq.:
(1) State Art, Historical and Cultural Preservation Agency (La. Rev. Stat. 25:801 et seq.).
(2) Toledo Bend Forest Scenic Drive Commission (La. Rev. Stat. 48:1401 et seq.).
(3) Louisiana Art Commission (La. Rev. Stat. 25:301 et seq.).
(4) Louisiana Historical Preservation and Cultural Commission (La. Rev. Stat. 25:521 et seq.).
(5) Orleans Parish Landmarks Commission (La. Rev. Stat. 25:381 and 382).
C. The following agencies are hereby placed within the Department of Culture, Recreation and Tourism and shall exercise and perform their powers, duties, functions, and responsibilities in accordance with the provisions of La. Rev. Stat. 36:801.1:
(1) The Louisiana Naval War Memorial Commission (La. Rev. Stat. 25:1000 et seq.).
(2) The Kenner Naval Museum Commission (La. Rev. Stat. 25:1005 et seq.).
(3) The New Orleans City Park Improvement Association and its board of commissioners (Act No. 130 of the 1896 Regular Session of the Legislature; Act No. 104 of the 1934 Regular Session of the Legislature; Act No. 492 of the 1958 Regular Session of the Legislature; Act No. 405 of the 1962 Regular Session of the Legislature; Act No. 865 of the 1982 Regular Session of the Legislature; Act No. 569 of the 1989 Regular Session of the Legislature; Act No. 13 of the 1998 First Extraordinary Session of the Legislature; Act No. 395 of the 2006 Regular Session of the Legislature).
(4) The Council for the Development of French in Louisiana (La. Rev. Stat. 25:651 et seq.).
(5) The board of directors of the Dew Drop-America’s Rock and Roll Museum (La. Rev. Stat. 25:380.41 et seq.).
D. The following agencies are hereby placed within the Department of Culture, Recreation and Tourism and shall exercise and perform their powers, duties, functions, and responsibilities in accordance with the provisions of La. Rev. Stat. 36:802:
(1) The Louisiana Byways Commission (La. Rev. Stat. 56:1948.11 et seq.), except that the commission may appoint the Louisiana Byways Program coordinator and one additional employee as provided in La. Rev. Stat. 56:1948.12(D).
(2) The Louisiana Seafood Promotion and Marketing Board (La. Rev. Stat. 56:578.1 et seq.).
(3) The Atchafalaya Trace Commission, as more specifically provided for in La. Rev. Stat. 25:1221 et seq., except that the commission shall continue to appoint its own director and assistant director or personnel to fill comparable positions as authorized by law.
E. The State Board of Library Examiners (La. Rev. Stat. 25:222 and 223) is hereby transferred to and hereafter shall be within the Department of Culture, Recreation and Tourism, as provided in La. Rev. Stat. 36:803.
