Terms Used In Louisiana Revised Statutes 39:100.35

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Docket: A log containing brief entries of court proceedings.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fund: means an independent fiscal and accounting entity with a self-balancing set of accounts recording cash or other resources together with all related liabilities, obligations, reserves, and equities which are segregated for the purpose of carrying on specific activities or attaining certain objectives in accordance with regulations, restrictions, and limitations. See Louisiana Revised Statutes 39:2
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

            A. There shall be established in the state treasury, as a special permanent trust fund, the Calcasieu River Bridge Fund, hereinafter referred to as the “fund”. After allocation of money to the Bond Security and Redemption Fund as provided in La. Const. Art. VII, § 9(B) , and notwithstanding any other provision of law to the contrary, the treasurer shall deposit in and credit to the fund, the proceeds received by the state of Louisiana from the settlement, judgment, or final disposition of the litigation filed by the state of Louisiana or the Louisiana Department of Transportation and Development bearing Docket Number 2008-002684 in the Fourteenth Judicial District Court, or any other litigation filed by the state of Louisiana or Department of Transportation and Development claiming damages for actual or alleged subsurface contamination within two miles of the Interstate 10 Calcasieu River Bridge for incidents occurring prior to August 1, 2019, and alleged to require remediation.

            B. All unexpended and unencumbered monies in the fund at the end of the fiscal year shall remain in the fund. The monies in the fund shall be invested by the state treasurer in the same manner as monies in the state general fund, and interest earned on the investment of those monies shall be credited to the fund.

            C. Subject to an appropriation by the legislature, monies in the fund shall be used solely for the planning and construction of a new Interstate 10 Calcasieu River Bridge in Lake Charles.

            D. The dedication of recovered funds pursuant to the provisions of this Section shall not be admissible in any trial or litigation referenced in Subsection A of this Section.
