Terms Used In Louisiana Revised Statutes 42:1191

  • Board: means the Board of Ethics. See Louisiana Revised Statutes 42:1102
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Person: means an individual or legal entity other than a governmental entity, or an agency thereof. See Louisiana Revised Statutes 42:1102
  • Public employee: means anyone, whether compensated or not, who is:

                (i) An administrative officer or official of a governmental entity who is not filling an elective office. See Louisiana Revised Statutes 42:1102

  • Service: means the performance of work, duties, or responsibilities, or the leasing, rental, or sale of movable or immovable property. See Louisiana Revised Statutes 42:1102

            A. A person may request expungement of ethics enforcement records relative to a complaint filed with the Board of Ethics in which it is alleged that the person violated one or more provisions of this Chapter if each of the following requirements is satisfied:

            (1) The allegations in the complaint involved the person’s status as a public employee.

            (2) The person was a public employee solely because of his uncompensated service on a board or commission.

            (3) The Board of Ethics issued charges based on the complaint that, at the conclusion of enforcement proceedings, did not result in a finding of a violation of this Chapter.

            B. This Part shall not apply to enforcement proceedings that are concluded by consent opinion.
