Terms Used In Louisiana Revised Statutes 17:407.37
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Department: means the state Department of Education. See Louisiana Revised Statutes 17:407.33
- Early learning center: means any child day care center, Early Head Start Center, Head Start Center, or stand-alone prekindergarten program not attached to a school. See Louisiana Revised Statutes 17:407.33
- Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
The department may take action against a person who operates an early learning center without a valid license issued by the department. Such actions may include the following:
(1) Assessing a civil fine of up to one thousand dollars for each day of the knowing and continued unlicensed operation of an early learning center.
(2) Filing a suit in the district court in the parish in which the center is located for injunctive relief, including a temporary restraining order, to enjoin the institution, agency, corporation, person or persons, or any other group from continuing the violation.
