Louisiana Revised Statutes 30:101.4 – Fishermen’s Gear Compensation and Underwater Obstruction Removal Program
Terms Used In Louisiana Revised Statutes 30:101.4
- Assistant secretary: means the assistant secretary of the office of conservation within the Department of Energy and Natural Resources or his authorized representatives. See Louisiana Revised Statutes 30:101.3
- Department: means the Department of Energy and Natural Resources. See Louisiana Revised Statutes 30:101.3
- Program: means the Fishermen's Gear Compensation and Underwater Obstruction Removal Program. See Louisiana Revised Statutes 30:101.3
- Secretary: means the secretary of the Department of Energy and Natural Resources or his authorized representatives. See Louisiana Revised Statutes 30:101.3
- Underwater obstruction: means any obstacle, whether natural or manmade, which impedes normal navigation and commercial fishing on the navigable waters of the state. See Louisiana Revised Statutes 30:101.3
A. The Fishermen’s Gear Compensation and Underwater Obstruction Removal Program is hereby created within the office of the secretary of the Department of Energy and Natural Resources and shall be administered, for purposes of fishermen’s gear compensation, by the assistant secretary of the office of coastal management and, for purposes of underwater obstruction, by the assistant secretary of the office of conservation.
B. The assistant secretary shall adopt rules and regulations, in accordance with the Administrative Procedure Act, to implement the provisions of this Part and to provide for procedures for the identification, inventory, and removal of underwater obstructions to navigation and commercial fishing.
