Terms Used In Louisiana Revised Statutes 30:2288.1

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Person: means any individual, municipality, public or private corporation, partnership, firm, the United States Government, and any agent or subdivision thereof or any other juridical person, which shall include, but not be limited to, trusts, joint stock companies, associations, the state of Louisiana, political subdivisions of the state of Louisiana, commissions, and interstate bodies.   • Secretary: means the secretary of the Department of Environmental Quality. See Louisiana Revised Statutes 30:2004

A.  Notwithstanding La. Rev. Stat. 30:2286.1(A), a responsible person who undertakes and completes an approved remedial action plan shall be exempt from liability under Part I of this Chapter if the remedial actions are undertaken and completed in accordance with this Section.

B.  The remedial actions shall be undertaken and completed in accordance with a voluntary remedial action plan approved as provided in La. Rev. Stat. 30:2286.1.  Notwithstanding La. Rev. Stat. 30:2286, a voluntary remedial action plan submitted by a responsible person shall require the remedy or removal of all discharges or disposals and threatened discharges or disposals at the identified area of immovable property.  The identified area of immovable property must correspond to the boundaries of a parcel that is either separately platted or is the entire parcel.

C.  Subject to the provisions of La. Rev. Stat. 30:2289, when the secretary issues a certificate of completion for remedial actions completed at an identified area of immovable property in accordance with this Section, the exemption from liability under this Part applies to:

(1)  A person who acquires the identified immovable property after approval of the voluntary remedial action plan.

(2)  A successor or assign of a person to whom the liability exemption applies under this Subsection.

D.  Any person who provides financing for the implementation of a remedial action plan or for the development of the identified immovable property in accordance with the applicable use restrictions after completion and acceptance of said plan, shall not be liable for any damages, costs, or penalties under this Chapter unless such person is considered to be a responsible person under the provisions of Part I of this Chapter.
