Terms Used In Louisiana Revised Statutes 33:1333

  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.

Any political subdivision may make agreements pursuant to La. Rev. Stat. 33:1324 and 1324.1 in order to create greater efficiency and  economy and further extension of services in the area of solid waste disposal.  All such agreements shall be pursuant to the provisions of this Part, but, in addition to the ability to acquire by gift, grant, purchase, or condemnation proceedings as provided in La. Rev. Stat. 33:1329, the political subdivisions may use any state equipment that may be available for purposes of solid waste disposal.  The political subdivisions pursuant to La. Rev. Stat. 33:1332 may issue bonds to finance construction, acquisition, improvement, maintenance, or operation of such public projects, which are hereby declared to be works of public improvement under Part III of Chapter 4 of Subtitle II of Title 39 of the Louisiana Revised Statutes of 1950 and La. Const. Art. VI, § 32 of 1974, thereby allowing such political subdivisions to collect an ad valorem tax pursuant to the procedure set forth in La. Const. Art. VI, § 32 of 1974 and applicable law.  Arrangements for financing such operations, including the issuance of bonded indebtedness, shall be set forth in the agreement between the political subdivisions as required by La. Rev. Stat. 33:1331.
