Terms Used In Louisiana Revised Statutes 46:288.9

  • Department: means the Department of Children and Family Services. See Louisiana Revised Statutes 46:288.2
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Youth: means an individual who was adjudicated as a child in need of care, was in foster care in the department's custody on the day before his eighteenth birthday, and is at least eighteen years of age but less than twenty-one years of age. See Louisiana Revised Statutes 46:288.2

            Notwithstanding any other provision of law, the department may extend an adoption or guardianship subsidy to the adoptive parent or guardian with whom the department established a subsidy arrangement for a youth who initially was adopted from or entered guardianship from foster care and began receiving the adoption or guardianship subsidy after age sixteen, but prior to age eighteen, if the adoptive parents or guardians remain financially responsible for the youth and the youth meets the same criteria for eligibility set forth in La. Rev. Stat. 46:288.3 to participate in the state’s extended foster care program.
