Terms Used In Louisiana Revised Statutes 8:79
- Board: means the Louisiana Cemetery Board. See Louisiana Revised Statutes 8:1
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Venue: The geographical location in which a case is tried.
No action or claim based on or arising out of a violation of this Title or any rules or regulations of the board shall be brought unless a complaint is issued by the board in accordance with La. Rev. Stat. 8:66.1 or legal proceedings are filed in a court of competent jurisdiction and proper venue within the limitation provided in La. Rev. Stat. 37:21. The provisions of this Section are remedial and apply to all causes of action without regard to the date when the alleged act, omission, or neglect occurred.
