Terms Used In Louisiana Revised Statutes > Title 40 > Chapter 11 - State Department of Health
- Accumulated contributions: means the sum of all amounts paid by a member, excluding interest paid on the repayment of a refund, and credited to his individual account in the employee's savings account, together with regular interest credited prior to July 1969. See Louisiana Revised Statutes 11:403
- Acquired brain injury: means an injury to the brain that has occurred after birth and is not hereditary, congenital, or degenerative. See Louisiana Revised Statutes 40:2120.33
- Activity: means a distinct subset of functions or services within a program. See Louisiana Revised Statutes 39:2
- Adult: means an individual eighteen years of age or older. See Louisiana Revised Statutes 40:2120.33
- Adult day health care: means a medical model adult day health care program designed to provide services for medical, nursing, social, care management, and personal care needs to adults who are functionally impaired. See Louisiana Revised Statutes 40:2120.42
- Adult residential care home: means a publicly or privately operated residence that provides personal assistance, lodging, and meals for compensation to two or more adults who are unrelated to the residence licensee, operator, or administrator. See Louisiana Revised Statutes 40:2166.3
- Adult residential care provider: means a facility, agency, institution, society, corporation, partnership, company, entity, residence, person or persons, or any other group which provides adult residential care for compensation to two or more adults who are unrelated to the licensee or operator. See Louisiana Revised Statutes 40:2166.3
- Advertisement: means any promotion of 900, 976, or any other pay-per-call service by means of any radio, television, video or print media, telemarketing, or any other communication promoting a 900 or 976 number, service, or program to consumers. See Louisiana Revised Statutes 51:1730
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Agency: means any governmental body employing persons and includes departments, agencies, boards, commissions, and courts. See Louisiana Revised Statutes 11:403
- Agency: means any state office, department, board, commission, institution, division, officer or other person, or functional group, heretofore existing or hereafter created, that is authorized to exercise, or that does exercise, any functions of the government of the state in the executive branch, but not any governing body or officer of any local government or subdivision of the state, or any parochial officer who exercises functions coterminous with the municipality in which he performs those functions. - Agent: means a person who solicits prospective purchasers or negotiates on behalf of a seller. See Louisiana Revised Statutes 51:1821
- Allegation: something that someone says happened.
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Amount financed: means the amount borrowed under a consumer loan, revolving loan or lender credit card account, plus any other charges, fees, and closing costs authorized by law, that are financed by the creditor under the transaction, or included in or added to the balance of the consumer's indebtedness subject to loan finance charges. See Louisiana Revised Statutes 9:3516
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- ANSI: means the American National Standards Institute. See Louisiana Revised Statutes 40:1664.3
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- Applicant: means an entity applying for a community-based care facility license from the Louisiana Department of Health. See Louisiana Revised Statutes 40:2162.3
- Appropriation: means an authorization by the legislature to a budget unit for a program to expend from public funds a sum of money, for purposes designated, under the procedure prescribed in this Chapter. See Louisiana Revised Statutes 39:2
- ASCE: means the American Society of Civil Engineers. See Louisiana Revised Statutes 40:1664.3
- ASME: means the American Society of Mechanical Engineers. See Louisiana Revised Statutes 40:1664.3
- Authorized positions: means the number of positions approved by the legislature in an appropriation bill to be funded by the salaries continuing category of the accounting system for the state. See Louisiana Revised Statutes 39:2
- Autonomous: refers to a separate and distinct operational entity which functions under its own administration and bylaws, either within or independently of a parent organization. See Louisiana Revised Statutes 40:2182
- bait: means any substance that is manufactured or processed into a substantially different form than the raw materials and is sold for the purpose of attracting crawfish to traps. See Louisiana Revised Statutes 3:556.2
- Balance in any fund: means the deficit or surplus in any fund at the close of the fiscal year. See Louisiana Revised Statutes 39:2
- Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
- Base pay: means prescribed compensation for a specific position on a full-time basis, but does not include overtime, per diem, differential pay, payment in kind, premium pay, or any other allowance for expense authorized and incurred as an incident to employment, except supplemental pay for certain members as provided by Article X, Section 10(A)(1) of thethe Louisiana Constitution of 1974. - Behavioral services: means services that identify maladaptive behaviors which interfere with the persons safe integration into the community and the formulation of an inclusive behavior management program to decrease identified maladaptive behaviors. See Louisiana Revised Statutes 40:2120.33
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Beneficiary: means any person designated to receive a pension, an annuity, a retirement allowance, or other benefit as provided by this Subpart. See Louisiana Revised Statutes 11:3682
- Board: means the Louisiana Crawfish Promotion and Research Board. See Louisiana Revised Statutes 3:556.2
- Board: means the Calcasieu Ship Channel Funding Management Board. See Louisiana Revised Statutes 34:221
- Board: means the Louisiana State Board of Medical Examiners. See Louisiana Revised Statutes 40:2198.11
- Board: means the Board of Trustees of the Louisiana State Employees' Retirement System. See Louisiana Revised Statutes 11:403
- Board: means the Louisiana Life Safety and Property Protection Education Board. See Louisiana Revised Statutes 40:1664.3
- board: means the board provided for in Louisiana Revised Statutes 11:3682
- Brain injury: means an acquired or traumatic injury to the brain. See Louisiana Revised Statutes 40:2120.33
- Budget office: means the section of the division of administration which monitors budgeting functions. See Louisiana Revised Statutes 39:2
- Budget unit: means any spending agency of the state which is declared to be a budget unit by the division of administration and which is identified for accounting purposes by a five-digit number code. See Louisiana Revised Statutes 39:2
- Business opportunity: means the sale or lease for an initial required consideration exceeding three hundred dollars of any goods or services which are transferred to a purchaser for the purpose of enabling the purchaser to start a business, and in which the seller or agent:
(a) Represents that the seller or an entity to which it will refer the purchaser, will provide or assist the purchaser in finding business locations on premises neither owned nor leased by the purchaser or seller for the use or operation of vending machines, racks, display cases, currency-operated amusement machines, or other similar devices; or
(b) Represents that the seller, or any entity to which it will refer the purchaser, will purchase any or all products to be sold, made, produced, fabricated, assembled, grown, bred, or modified by the purchaser using in whole or in part the supplies, services, or goods sold to the purchaser by the seller; or
(c) Guarantees that the purchaser is to derive income from the business opportunity which exceeds the price paid for the business opportunity, or that the seller is to refund all or part of the price paid for the business opportunity, or repurchase any of the products, equipment, supplies, or goods supplied by the seller, if the purchaser is unsatisfied with the business opportunity; or
(d) Represents that for a fee exceeding three hundred dollars the seller will provide a sales plan or marketing program which will enable the purchaser to derive income from the business opportunity which exceeds the price paid for the business opportunity. See Louisiana Revised Statutes 51:1821
- Capital outlays: means expenditures for acquiring lands, buildings, equipment, or other permanent properties, or for their preservation or development or permanent improvement. See Louisiana Revised Statutes 39:2
- Carrier: means any company that provides telecommunications transmission services. See Louisiana Revised Statutes 51:1730
- Certified nurse aide: means an individual who has completed a Nurse Aide Training and Competency Evaluation Program approved by the state as meeting the requirements of Louisiana Revised Statutes 40:2120.13
- Certified nurse aide: means a certified nursing assistant or certified nurse aide employed by a nursing facility or contracted by a nursing facility. See Louisiana Revised Statutes 40:2120.51
- Certify: means to attest to the proper functionality, inspection, installation, integration, programming, and service of life safety and property protection systems and equipment in accordance with all applicable engineered specifications, manufacturer specifications, and submitted plans and per the inspection, testing and maintenance chapters as set forth in the applicable NFPA, ASME, ANSI, and ASCE codes, standards, and manufacturer specifications. See Louisiana Revised Statutes 40:1664.3
- Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
- Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
- Client: means an individual receiving care from an adult brain injury facility and shall include only individuals who are medically stable and do not require an IV, feeding tube, or other artificial or mechanical supports for life sustaining processes. See Louisiana Revised Statutes 40:2120.33
- Client: means any person who has been accepted for treatment or services, including rehabilitation services, furnished by a facility licensed pursuant to this Part. See Louisiana Revised Statutes 40:2162.3
- Cognitive rehabilitation: means a systematic, functionally oriented service of therapeutic cognitive activities based on an assessment and an understanding of the behavior of a client. See Louisiana Revised Statutes 40:2120.33
- Commissioner: means the Louisiana commissioner of agriculture and forestry. See Louisiana Revised Statutes 3:556.2
- Commissioner: means the commissioner of financial institutions. See Louisiana Revised Statutes 9:3516
- Community integration: means the participation in the mainstream of community life and maintaining social relationships with family members, peers, and others in the community who do not have brain injuries. See Louisiana Revised Statutes 40:2120.33
- Community-based care facility: means a facility where five or more adults with a primary diagnosis of mental illness who are not related to the operator or administrator and who do not require care above intermediate-level nursing care reside and receive care, treatment, or services that are above the level of room and board and include no more than three hours of nursing care per week per resident. See Louisiana Revised Statutes 40:2162.3
- Community-based care services: means services provided in a community-based care facility licensed pursuant to the provisions of this Part. See Louisiana Revised Statutes 40:2162.3
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Consumer: means a telephone user or end-user who calls or may call a 900, 976, or any other pay-per-call service. See Louisiana Revised Statutes 51:1730
- Consumer: means a natural person who purchases goods, services, or movable or immovable property or rights therein, for a personal, family, or household purpose and includes a purchaser or buyer in a consumer credit sale or transaction made with the use of a seller credit card or otherwise, or a borrower or debtor in a consumer loan, revolving loan account, or a lender credit card. See Louisiana Revised Statutes 9:3516
- Consumer credit transaction: means a consumer loan or a consumer credit sale but does not include a motor vehicle credit transaction made pursuant to Louisiana Revised Statutes 9:3516
- Consumer loan: means a loan of money or its equivalent made by a supervised financial organization, a licensed lender, or lender in which the debtor is a consumer, and the loan is entered into primarily for personal, family, or household purposes and includes debts created by the use of a lender credit card, revolving loan account, or similar arrangement, as well as insurance premium financing. See Louisiana Revised Statutes 9:3516
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- conveyance device: means any of the following, except those located in one- or two-family dwellings as defined in La. See Louisiana Revised Statutes 40:1664.3
- Conveyance device mechanic: means any person engaged in the erecting, constructing, installing, altering, servicing, dismantling, maintaining, or testing of a conveyance device. See Louisiana Revised Statutes 40:1664.3
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Corps: means the U. See Louisiana Revised Statutes 34:221
- Credit service charge: means the sum of the following:
(i) All charges payable directly or indirectly by the consumer and imposed directly or indirectly by the seller as an incident to the extension of credit, including any of the following types of charges that are applicable: time price differential; service; carrying or other charge, however denominated; premium or other charge for any guarantee or insurance protecting the seller against the consumer's default or other credit loss; and
(ii) Charges paid by the consumer for investigating the collateral or credit worthiness of the consumer or for commissions or brokerage for obtaining the credit, irrespective of the person to whom the charges are paid or payable, unless the seller had no notice of the charges when the credit was granted. See Louisiana Revised Statutes 9:3516
- Creditable service: means prior service plus membership service for which credit is allowable as provided in this Chapter. See Louisiana Revised Statutes 11:403
- Creditable service: means service for which credit is allowable as provided in Louisiana Revised Statutes 11:3682
- Crisis receiving centers: means an agency, business, institution, society, corporation, person or persons, or any other group, licensed by the Louisiana Department of Health to provide crisis identification, intervention, and stabilization services for people in behavioral crisis. See Louisiana Revised Statutes 40:2180.12
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Deed: The legal instrument used to transfer title in real property from one person to another.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Deficit: means the excess for any fiscal year of actual expenditures paid by warrant or transfer over the actual monies received and any monies or balances carried forward for any fund at the close of the fiscal year as such are reported by the office of statewide reporting within the division of administration. - department: means the Department of Energy and Natural Resources of the state of Louisiana. See Louisiana Revised Statutes 51:1602
- Department: means the Department of Justice. See Louisiana Revised Statutes 51:1730

- Direct supervision: means oversight of a firm's operations by a qualifier or onsite supervision by a licensed technician or specialist of an apprentice or consultant. See Louisiana Revised Statutes 40:1664.3
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
- Distributee: means a member or former member. See Louisiana Revised Statutes 11:3682
- District: means the Jefferson Parish Communication District as created by Act No. See Louisiana Revised Statutes 33:9125
- DMMP: means the Dredged Material Management Plan dated November 22, 2010, as adopted by the U. See Louisiana Revised Statutes 34:221
- Docket: A log containing brief entries of court proceedings.
- Donor: The person who makes a gift.
- door hardware: means stand alone electro/mechanical locks, latches, exit hardware, closures, and hinges mounted onto doors intended to operate and secure the door properly. See Louisiana Revised Statutes 40:1664.3
- DOT: means the United States Department of Transportation. See Louisiana Revised Statutes 40:1664.3
- Earned compensation: means the base pay earned by an employee for a given pay period as reported to the system on a monthly basis by the agency which shall include the cash value of any emolument of office in the form of paid compensation in lieu of salary which is subject to federal and state payroll taxes and includes the full amount earned by an employee, overtime, and per diem earned by an employee of the House of Representatives, the Senate, or an agency of the legislature, and expense allowances and per diem paid to members of the legislature, the clerk, or sergeant at arms of the House of Representatives and president and secretary or sergeant at arms of the Senate. - Earned compensation: means the full amount of compensation earned by an employee for a given month, but shall not include overtime. See Louisiana Revised Statutes 11:3682
- Efficiency: means cost-effectiveness or productivity relative to achievement of an objective. See Louisiana Revised Statutes 39:2
- Eligible retirement plan: means an individual retirement account described in Section 408(a), an individual retirement annuity described in Section 408(b), an annuity plan described in Section 403(a), or a qualified trust described in Section 401(a), all of the Internal Revenue Code, that accepts the member's eligible rollover distribution. See Louisiana Revised Statutes 11:3682
- Eligible rollover distribution: means any distribution of all or any portion of the balance to the credit of a member, except that an eligible rollover distribution does not include any distribution that is one of a series of substantially equal periodic payments not less frequently than annually, made for the life or life expectancy of the member or the joint lives or joint life expectancies of the member and the member's designated beneficiary, or for a specified period of ten years or more, or any distribution to the extent such distribution is required under Section 401(a)(9) of the Internal Revenue Code, or the portion of any distribution that is not includable in gross income. - Employee: means any person legally occupying a position in the state service. See Louisiana Revised Statutes 11:403
- Employee: means a person who performs services for wages or salary and receives a W-2 tax form from his employer. See Louisiana Revised Statutes 40:1664.3
- Employee: means any commissioned member or employee of the Harbor Police Department of the Port of New Orleans prior to July 1, 2004, or any commissioned member of the Harbor Police Department of the Port of New Orleans on or after July 1, 2004 and hired on or before June 30, 2014. See Louisiana Revised Statutes 11:3682
- Employer: means the state of Louisiana or any of its boards, commissions, departments, agencies, and courts which are contributing members of the Louisiana State Employees' Retirement System. See Louisiana Revised Statutes 11:403
- Employer: means the Board of Commissioners of the Port of New Orleans. See Louisiana Revised Statutes 11:3682
- End stage renal disease: means that stage of renal impairment that appears irreversible and permanent and that requires a regular course of dialysis or kidney transplantation to maintain life. See Louisiana Revised Statutes 40:2117.1
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Escrow: Money given to a third party to be held for payment until certain conditions are met.
- ESRD facility: means a facility that provides dialysis treatment or dialysis training to individuals diagnosed with end stage renal disease. See Louisiana Revised Statutes 40:2117.1
- Ex officio: Literally, by virtue of one's office.
- Exchange access facilities: means all lines, or their equivalent wireless service, provided for by the service supplier for the provision of local exchange service. See Louisiana Revised Statutes 33:9125
- Executive budget: means the document submitted to the legislature at each regular session, pursuant to the provisions of this Chapter and Louisiana Revised Statutes 39:2
- Expenses: means amounts represented by cash paid out or by obligations to pay cash or partly by each for maintaining and operating government services. See Louisiana Revised Statutes 39:2
- Extraordinary expenses: means expenses of unusual character such as in the normal course of events would not be expected to occur in each year, or the excess over the normal requirements due to unusual conditions in any budget year. See Louisiana Revised Statutes 39:2
- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- False alarm: means a security alarm signal eliciting a response by police when a situation requiring such a response does not exist, including but not limited to the activation or transmission of any alarm signal caused by human error, mechanical or electronic malfunction, negligence of the alarm system user or user's agent or employee, whether or not the exact cause of the alarm activation is determined, or any other activation or transmission of any alarm signal where no actual police emergency exists. - Fiduciary: A trustee, executor, or administrator.
- Finance charge: The total cost of credit a customer must pay on a consumer loan, including interest. The Truth in Lending Act requires disclosure of the finance charge. Source: OCC
- Financial viability: means that the provider seeking a home- and community-based service provider license is able to provide verification and maintenance of:
(a) A line of credit issued from a federally insured, licensed lending institution in the amount of at least fifty thousand dollars. See Louisiana Revised Statutes 40:2120.2
- Financial viability: means the ability of the licensee to maintain capital, lines of credit, insurance, and other financial resources at levels deemed sufficient by the Louisiana Department of Health for operation of a community-based care facility. See Louisiana Revised Statutes 40:2162.3
- Financial viability: means the provider or facility seeking licensure is able to provide at least one of the following:
(a) Verification of sufficient assets equal to one hundred thousand dollars or the cost of three months of operation, whichever is less. See Louisiana Revised Statutes 40:2166.3
- Firm: means a sole proprietorship, partnership, corporation, limited liability company, or any other entity. See Louisiana Revised Statutes 40:1664.3
- Firm license: means that document authorizing a firm to perform life safety and property protection contracting for those endorsements held. See Louisiana Revised Statutes 40:1664.3
- First trimester: means the time period up to fourteen weeks after the first day of the last menstrual period. See Louisiana Revised Statutes 40:2175.3
- Fiscal year: means the period beginning July first of any year and ending June thirtieth of the next succeeding year. See Louisiana Revised Statutes 11:403
- Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
- You are late making a payment or commit some other default, triggering an increase to a penalty rate
- The bank changes the terms of your account and you do not reject the change.
- The rate expires (if the rate was fixed for only a certain period of time).
- Forbearance: A means of handling a delinquent loan. A
- Functional limitations: means actual behaviors or mental or physical disabilities exhibited by adults with brain injuries or conditions presented by their environments, or both, that shall be modified or minimized in order for clients to fulfill their potential or maximize their functioning. See Louisiana Revised Statutes 40:2120.33
- functionally impaired adults: shall mean individuals aged seventeen years of age and older who are physically, mentally, or socially impaired to a degree that supervision is necessary. See Louisiana Revised Statutes 40:2120.2
- Functionally impaired adults: means persons seventeen years of age or older who are physically or mentally impaired to a degree that they are in need of supervision. See Louisiana Revised Statutes 40:2120.42
- Fund: means the Calcasieu River Fund which is a separate and distinct fund kept and maintained by the Port of Lake Charles. See Louisiana Revised Statutes 34:221
- Fund: means an independent fiscal and accounting entity with a self-balancing set of accounts recording cash or other resources together with all related liabilities, obligations, reserves, and equities which are segregated for the purpose of carrying on specific activities or attaining certain objectives in accordance with regulations, restrictions, and limitations. See Louisiana Revised Statutes 39:2
- Fund the district: means pay the expenses necessary to carry out all purposes of the district, including but not limited to identification of all streets, roads, highways, and dwelling places in the district and to provide for other communication enhancements for public safety agencies to decrease response time and improve effectiveness. See Louisiana Revised Statutes 33:9125
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Goal: means a general purpose toward which the efforts of an agency are directed. See Louisiana Revised Statutes 39:2
- Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Healthcare facility: means any person, partnership, corporation, unincorporated association, or other legal entity licensed pursuant to Louisiana Revised Statutes 40:2120.13
- Home- and community-based service provider: means an agency, institution, society, corporation, person or persons, or any other individual or group that provides one or more home- and community-based services as defined in this Section. See Louisiana Revised Statutes 40:2120.2
- Home- and community-based services: means one or more of the following services:
(a) Personal care attendant services, which are defined as services required by a person with a disability in order to become physically independent or to remain in or return to the community. See Louisiana Revised Statutes 40:2120.2
- Hospice: means an autonomous, centrally administered, medically directed program providing a continuum of home, outpatient, and homelike inpatient care for the terminally ill patient and his family. See Louisiana Revised Statutes 40:2182
- Hospital: means any institution, place, building, or agency, public or private, whether for profit or not, with facilities for the diagnosis, treatment, or care of persons who are suffering from illness, injury, infirmity, or deformity or other physical condition for which obstetrical, medical, or surgical services would be available and appropriate and which operates or is affiliated with facilities for the overnight care, observation, or recovery of those persons. See Louisiana Revised Statutes 40:2102
- Impairment: means any loss or abnormality of psychological, cognitive, physiological, or anatomical structure or functioning. See Louisiana Revised Statutes 40:2120.33
- Individual license: means that document authorizing an individual to perform life safety and property protection contracting for those endorsements held. See Louisiana Revised Statutes 40:1664.3
- Industry: means a fixed facility located on the Calcasieu Ship Channel with a terminal having at least one vessel call utilizing a state-commissioned pilot. See Louisiana Revised Statutes 34:221
- Infirm elderly: means an individual sixty years of age or older who requires continuous care and supervision due to the infirmities of old age. See Louisiana Revised Statutes 40:2120.2
- Initial required consideration: includes consideration required by express condition or practical necessity, or for which the buyer or lessee becomes obligated before the commencement of the business, or during the following one hundred eighty days. See Louisiana Revised Statutes 51:1821
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Inspect: means a visual examination of life safety and property protection systems or equipment to verify that it appears to be in operating condition and is free of physical damage. See Louisiana Revised Statutes 40:1664.3
- Install: means the initial placement of life safety and property protection systems or equipment or an extension of such after initial placement. See Louisiana Revised Statutes 40:1664.3
- Integrate: means the act of utilizing accepted and approved life safety and property protection systems or equipment and components in accordance with manufacturers' direction to develop a unified and functioning system meeting applicable NFPA codes and standards. See Louisiana Revised Statutes 40:1664.3
- Interdisciplinary team: includes representatives from all of the core services as evidenced by documentation, planning, and team meetings. See Louisiana Revised Statutes 40:2182
- Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
- Job appointment: means employment for a fixed period not to exceed two years. See Louisiana Revised Statutes 11:403
- Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- Liability: means a debt arising out of a transaction where goods or services have been received or rendered which must be liquidated, renewed, or refunded at some future date. See Louisiana Revised Statutes 39:2
- License: means a license issued by the Louisiana Department of Health to a community-based care facility. See Louisiana Revised Statutes 40:2162.3
- License: means a license issued by the department to an adult residential care provider. See Louisiana Revised Statutes 40:2166.3
- Licensed lender: means a person licensed by the commissioner to make consumer loans pursuant to this Chapter. See Louisiana Revised Statutes 9:3516
- Licensee: means any nursing agency properly licensed in accordance with this Part. See Louisiana Revised Statutes 40:2120.13
- Licensee: means the person, partnership, corporation, association, organization, or professional entity on whom rests the ultimate responsibility and authority for the conduct of the outpatient abortion facility. See Louisiana Revised Statutes 40:2175.3
- Licensing agency: means the Louisiana Department of Health. See Louisiana Revised Statutes 40:2175.3
- Licensing board: means any board or commission that has the duty to license a regulated entity as defined in this Section. See Louisiana Revised Statutes 40:2199.12
- Lien: A claim against real or personal property in satisfaction of a debt.
- Life safety and property protection contracting: means performing certification, inspection, installation, integration, programming, sale, or service of systems and equipment designed to protect life and property. See Louisiana Revised Statutes 40:1664.3
- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- Mandatory reporter to law enforcement: means any abortion facility staff member or any abortion facility professional. See Louisiana Revised Statutes 40:2175.3
- Medical board: shall mean the State Medical Disability Board. See Louisiana Revised Statutes 11:403
- Medical staffing agency: means any agency, institution, society, corporation, person or persons, or any other group that provides, for profit, the services of certified nurse aides to a nursing facility. See Louisiana Revised Statutes 40:2120.51
- Medication management program: means a systematic, functionally oriented program formulated in consultation with the client's primary provider, and implemented by staff trained by a nursing director. See Louisiana Revised Statutes 40:2120.33
- Member: means any person included in the membership of the system. See Louisiana Revised Statutes 11:403
- Member: includes any employees, as defined in Paragraph (16) of this Section, included in the membership of this plan as provided in Louisiana Revised Statutes 11:3682
- Membership service: means service after July 1, 1947 as an employee while a member of the system. See Louisiana Revised Statutes 11:403
- Membership service: means service as an employee while a member of the Harbor Police Retirement System or this plan. See Louisiana Revised Statutes 11:3682
- Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
- NFPA: means the National Fire Protection Association. See Louisiana Revised Statutes 40:1664.3
- Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
- Non-federal sponsor: means the Lake Charles Harbor and Terminal District acting on behalf of the state of Louisiana, as authorized by Louisiana Revised Statutes 34:221
- Nurse: means a registered nurse as defined in Louisiana Revised Statutes 40:2120.13
- Nurse staffing agency: means any person, partnership, corporation, unincorporated association, or other legal entity that employs, assigns, or refers nurses or certified nurse aides to render healthcare services in a healthcare facility for a fee. See Louisiana Revised Statutes 40:2120.13
- Nursing director: means a person who meets the legal requirement of a registered nurse in Louisiana. See Louisiana Revised Statutes 40:2120.33
- Nursing facility: means a nursing home licensed by the Louisiana Department of Health pursuant to La. See Louisiana Revised Statutes 40:2120.51
- Oath: A promise to tell the truth.
- Objective: is a specific and measurable target for achievement which describes the exact results sought, which is expressed in an outcome-oriented statement that may reflect effectiveness, efficiency, or quality of work, and which may be either numeric or non-numeric. See Louisiana Revised Statutes 39:2
- Officer: means the president, vice president, secretary, treasurer, comptroller, or any other person who performs functions for a life safety and property protection contracting firm corresponding to those performed by those officers. See Louisiana Revised Statutes 40:1664.3
- Official forecast: means the most recently adopted estimate of money available for appropriation by the Revenue Estimating Conference as provided in Louisiana Revised Statutes 39:2
- Operating location: means a physical address that houses an entity that performs life safety and property protection contracting. See Louisiana Revised Statutes 40:1664.3
- Ordinary recurring expenses: means all expenses of a continuing or recurring character, that in the normal course of administration, may be expected to be necessary in approximately the same amounts each year. See Louisiana Revised Statutes 39:2
- Organization: means corporation, government or governmental subdivision or agency, trust, estate, partnership, cooperative, or association. See Louisiana Revised Statutes 9:3516
- Outlays: Outlays are payments made (generally through the issuance of checks or disbursement of cash) to liquidate obligations. Outlays during a fiscal year may be for payment of obligations incurred in prior years or in the same year.
- Outpatient abortion facility: means any outpatient facility, other than a hospital as defined in Louisiana Revised Statutes 40:2175.3
- Oversight: Committee review of the activities of a Federal agency or program.
- Pain management clinic: means a publicly or privately owned facility which primarily engages in the treatment of pain by prescribing narcotic medications. See Louisiana Revised Statutes 40:2198.11
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Pay-per-call service: means any passive, interactive, polling, or other similar audiotext service that is accessed through a seven or ten digit telephone number that is provided for a charge to a caller through an exclusive telephone number prefix or service access code. See Louisiana Revised Statutes 51:1730
- Person: means any individual, partnership, corporation, association, governmental subdivision, or public or private organization of any character. See Louisiana Revised Statutes 51:1602
- Person: means any individual, corporation, partnership, association, or other legal entity. See Louisiana Revised Statutes 3:556.2
- Person: as used in this Chapter means an individual or corporation, partnership, trust, association, joint venture pool, syndicate, sole proprietorship, unincorporated organization, or any other form of entity not specifically listed herein. See Louisiana Revised Statutes 9:3516
- Person: means the state, and any political subdivision or municipal corporation thereof, an individual, firm, partnership, corporation, company, association or joint stock association, or the legal successor thereof. See Louisiana Revised Statutes 40:2102
- Person: means a natural person or individual. See Louisiana Revised Statutes 40:1664.3
- person with a disability: shall mean a person with a physical, mental, or medical condition or an adult who requires assistance with activities of daily living. See Louisiana Revised Statutes 40:2120.2
- Personal care: means services and supports including but not limited to:
(a) Bathing, hair care, skin care, shaving, nail care, oral hygiene, overall hygiene, and activities of daily living. See Louisiana Revised Statutes 40:2120.33
- Physician: means an individual who possesses a current, unrestricted license to practice medicine in Louisiana, who during the course of his practice has not been denied the privilege of prescribing, dispensing, administering, supplying, or selling any controlled dangerous substance and who has not during the course of his practice had board action taken against his medical license as a result of dependancy on drugs or alcohol. See Louisiana Revised Statutes 40:2198.11
- Plaintiff: The person who files the complaint in a civil lawsuit.
- Plan: means the Harbor Police Retirement Plan established in this Subpart and administered as a plan within the Louisiana State Employees' Retirement System pursuant to Louisiana Revised Statutes 11:3682
- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Port: means the Lake Charles Harbor and Terminal District. See Louisiana Revised Statutes 34:221
- Position: means any office or any employment in the state service. See Louisiana Revised Statutes 11:403
- PPA: means the project partnership agreement between the non-federal sponsor and the U. See Louisiana Revised Statutes 34:221
- Primary provider: means a provider board certified in his specialty who currently holds a valid license in Louisiana. See Louisiana Revised Statutes 40:2120.33
- Principal: means the amount financed or amount deferred under a consumer credit transaction. See Louisiana Revised Statutes 9:3516
- Principal: includes a person or entity entitled to exercise the prerogatives or indicia of ownership or control of a property protection firm whether by direct action, assignment, or any other kind of substitution or subrogation. See Louisiana Revised Statutes 40:1664.3
- Prior service: means service rendered prior to August 1, 1971 for which credit is allowable as provided in Louisiana Revised Statutes 11:3682
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Program: means a grouping of activities directed toward the accomplishment of a clearly defined objective or set of objectives. See Louisiana Revised Statutes 39:2
- Project costs: means all costs necessary for the planning, development, acquisition, construction, extension, or improvement of a revenue bond project, including site acquisition and preparation and installation of utilities, architectural, engineering, supervising, accounting, inspection, legal, and financing fees and costs, preparation of feasibility studies and reports, interest on revenue bonds and notes during construction and for a reasonable period thereafter, establishment of reserves to secure the bonds and notes, and all other expenditures incidental and necessary or convenient therefor. See Louisiana Revised Statutes 51:1602
- Projected deficit: means the excess of appropriations and non-appropriated requirements over the official forecast for any fund during any fiscal year. See Louisiana Revised Statutes 39:2
- Property protection systems and equipment: means those life safety and property protection systems intended to protect lives and property from the risk of theft, unauthorized entry, or other physical harm to a structure's occupants or property. See Louisiana Revised Statutes 40:1664.3
- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- provider: means any place owned or operated for profit or nonprofit by a person, society, agency, corporation, institution, or any other group wherein two or more functionally impaired adults who are not related to the owner or operator of such agency are provided with adult day health care services, as defined in this Section. See Louisiana Revised Statutes 40:2120.42
- Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
- Public safety agency: means law enforcement, fire, emergency medical services, and emergency preparedness services as designated by the parish of Jefferson. See Louisiana Revised Statutes 33:9125
- Quality: means degree or grade of excellence. See Louisiana Revised Statutes 39:2
- Quarter: means a calendar quarter more specifically defined as follows:
(a) First quarter: January, February, and March. See Louisiana Revised Statutes 3:556.2
- Quorum: The number of legislators that must be present to do business.
- Refund: means the withdrawal of all accumulated contributions at least thirty days after termination from the state service, or with respect to members having the option of belonging to the system, withdrawal of all accumulated contributions at least thirty days after receipt by the system of written notice of withdrawal. See Louisiana Revised Statutes 11:403
- Regulated entity: means any licensed healthcare facility listed in Louisiana Revised Statutes 40:2199.12
- Rehabilitation: means the process of providing those comprehensive services deemed appropriate to the needs of a client in a coordinated manner in a program designed to achieve functional objectives of improved health, welfare, maximum physical, cognitive, social, psychological, and community functioning. See Louisiana Revised Statutes 40:2120.33
- Rehabilitative treatment environment: means a rehabilitation setting that provides for all of the following:
(a) A provision of a range of choices, with personal preference, self-determination, and dignity of risk receiving full respect and consideration. See Louisiana Revised Statutes 40:2120.33
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
- Retirement: means termination of active service, with a retirement allowance granted under the provisions of this Chapter. See Louisiana Revised Statutes 11:403
- Retirement: means withdrawal from active service with a retirement allowance granted under the provisions of this Subpart. See Louisiana Revised Statutes 11:3682
- Retirement allowance: means any benefit paid to a member under Louisiana Revised Statutes 11:3682
- Revenue Bond Projects: means any one or more of the facilities authorized to be financed by the issuance of revenue bonds pursuant to the provisions of this Chapter. See Louisiana Revised Statutes 51:1602
- Revenue bonds: means any bonds or notes issued pursuant to this Chapter. See Louisiana Revised Statutes 51:1602
- Revenues: include fees, proceeds, moneys, receipts, and income derived for the account of the Department of Energy and Natural Resources in connection with any revenue bond project or arising from the project. See Louisiana Revised Statutes 51:1602
- Second trimester: means the time period from fourteen to twenty-three weeks after the first day of the last menstrual period. See Louisiana Revised Statutes 40:2175.3
- secretary: means the secretary of the Department of Energy and Natural Resources of the state of Louisiana or such persons as the secretary may authorize to act for him as provided in Louisiana Revised Statutes 51:1602
- Secretary: means the secretary of the Louisiana Department of Health or his designee. See Louisiana Revised Statutes 40:2120.13
- Secretary: means the secretary of the Louisiana Department of Health or his designee. See Louisiana Revised Statutes 40:2120.51
- Secretary: means the secretary of the Louisiana Department of Health. See Louisiana Revised Statutes 40:2175.3
- Secretary: means the secretary of the Louisiana Department of Health. See Louisiana Revised Statutes 40:2102
- Sell: means to solicit another on behalf of a property protection firm by any means, including but not limited to telephone or electronic device, public notice or advertisement, door-to-door or any other type of personal interaction. See Louisiana Revised Statutes 40:1664.3
- Seller: means a person or entity which sells or leases, or offers to sell or to lease a business opportunity. See Louisiana Revised Statutes 51:1821
- Service: means to repair or maintain. See Louisiana Revised Statutes 40:1664.3
- Service: means service rendered as an employee as described in Paragraph (16) of this Section. See Louisiana Revised Statutes 11:3682
- Service of process: The service of writs or summonses to the appropriate party.
- Service supplier: means any person providing any of the following:
(a) A landline exchange telephone service. See Louisiana Revised Statutes 33:9125
- Ship channel: means the Calcasieu Ship Channel, which may also be referred to as the Calcasieu River and Pass Project. See Louisiana Revised Statutes 34:221
- Specialty endorsement: means a narrow category of license authorizing its holder to perform only one aspect of life safety and property protection contracting. See Louisiana Revised Statutes 40:1664.3
- Sponsor: means an individual, corporation, association, partnership, or other entity that sells a pay-per-call service on whose behalf charges are billed, but shall not include a public utility regulated by the state or the Federal Communications Commission or an interexchange carrier which provides transport or billing, or both, and collection services for a pay-per-call service, unless the public utility or interexchange carrier actually produces or promotes the pay-per-call service. See Louisiana Revised Statutes 51:1730
- Spouse: means that person who is legally married to the member on the member's effective date of retirement or effective date of participation in the Deferred Retirement Option Plan, whichever is earlier. See Louisiana Revised Statutes 11:3682
- State: means the state of Louisiana. See Louisiana Revised Statutes 11:403
- State fire marshal: means the Department of Public Safety and Corrections, office of state fire marshal, code enforcement and building safety, and its authorized representatives empowered to enforce the provisions of this Subpart. See Louisiana Revised Statutes 40:1664.3
- Statute: A law passed by a legislature.
- Student: means a person enrolled in a high school, a vocational-technical school, or a college or university, in a sufficient number of courses and classes in such institution to be classified as a full-time regular student under the criteria used by the institution in which he is enrolled. See Louisiana Revised Statutes 11:403
- Subpoena: A command to a witness to appear and give testimony.
- Subscriber: means any person or entity in whose name a telephone account is billed. See Louisiana Revised Statutes 51:1730
- Summons: Another word for subpoena used by the criminal justice system.
- Support: means activities, materials, equipment, or other services designed and implemented to assist the client with a brain injury. See Louisiana Revised Statutes 40:2120.33
- Supporting document: means the document prepared by the budget office and composed of supporting information, data, and documentation used to develop the executive budget. See Louisiana Revised Statutes 39:2
- Surplus: means the excess for any fiscal year of the actual monies received and any monies or balances carried forward over the actual expenditures paid by warrant or transfer for any fund at the close of the fiscal year as such are reported by the office of statewide reporting within the division of administration. See Louisiana Revised Statutes 39:2
- System: means the Louisiana State Employees' Retirement System. See Louisiana Revised Statutes 11:403
- system: means the Louisiana State Employees' Retirement System. See Louisiana Revised Statutes 11:3682
- Tariff rate: means the rate or rates billed by a service supplier as stated in the landline exchange telephone service supplier's tariffs and approved by the Public Service Commission, which represent the service supplier's recurring charges for landline exchange access facilities, exclusive of all taxes, fees, licenses, or similar charges whatsoever. See Louisiana Revised Statutes 33:9125
- Technical endorsement: means a broad category of license authorizing its holder to perform multiple aspects of life safety and property protection contracting within a certain endorsement. See Louisiana Revised Statutes 40:1664.3
- Technician: means an individual who is trained and certified to perform life safety and property protection contracting within a technical endorsement. See Louisiana Revised Statutes 40:1664.3
- Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
- Terminally ill: refers to a medical prognosis of limited expected survival, of approximately six months or less at the time of referral to a hospice, of an individual who is experiencing an illness for which therapeutic strategies directed toward cure and control of the disease alone are no longer appropriate. See Louisiana Revised Statutes 40:2182
- Termination: means complete cessation of employment with the state. See Louisiana Revised Statutes 11:403
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Testing: means calibration testing, conformance testing, or fixed system testing. See Louisiana Revised Statutes 40:1615
- Therapeutic recreational services: means services that identify leisure activities and assistance in modifying and adapting identified leisure activities to allow safe participation by the client as a means to improve quality of life and aid in integration into the community. See Louisiana Revised Statutes 40:2120.33
- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
- Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
- Transplantation services: means a process by which a kidney is excised from a live or cadaveric donor and is implanted in an end stage renal disease patient, and supportive care is furnished to the living donor and to the recipient following implantation. See Louisiana Revised Statutes 40:2117.1
- Trauma center: means a health care facility which is capable of treating one or more types of potentially seriously injured persons and which has been certified as a trauma center by the Louisiana Department of Health. See Louisiana Revised Statutes 40:2171
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Trustee: A person or institution holding and administering property in trust.
- Uphold: The decision of an appellate court not to reverse a lower court decision.
- User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
- Venue: The geographical location in which a case is tried.
- Vessel: means any watercraft utilizing a state-commissioned pilot to navigate the Calcasieu Ship Channel, whether foreign or domestic. See Louisiana Revised Statutes 34:221
- Vested right: means when a member obtains retirement eligibility as to age and service in accordance with the provisions of this Chapter. See Louisiana Revised Statutes 11:403
- Vocational services: means services provided directly or through cooperating agencies to a client in accordance with his individualized plan and designed to improve or enhance skills and behaviors necessary for successful placement in a volunteer or work setting. See Louisiana Revised Statutes 40:2120.33
- Workplace violence: means violent acts, including battery or the intentional placing of another person in reasonable apprehension of sustaining battery, directed toward persons at work or on duty with their employment. See Louisiana Revised Statutes 40:2199.12
