Terms Used In Louisiana Revised Statutes > Title 40 > Chapter 5-G - Miscellaneous Health Provisions

  • Agency: means any state office, department, board, commission, institution, division, officer or other person, or functional group, heretofore existing or hereafter created, that is authorized to exercise, or that does exercise, any functions of the government of the state in the executive branch, but not any governing body or officer of any local government or subdivision of the state, or any parochial officer who exercises functions coterminous with the municipality in which he performs those functions. See Louisiana Revised Statutes 39:2
  • Budget unit: means any spending agency of the state which is declared to be a budget unit by the division of administration and which is identified for accounting purposes by a five-digit number code. See Louisiana Revised Statutes 39:2
  • Commissioner: means the commissioner of administration. See Louisiana Revised Statutes 39:16.1
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the Department of Agriculture and Forestry. See Louisiana Revised Statutes 3:1
  • Director: means the chief administrative officer of the state office of rural development. See Louisiana Revised Statutes 3:313
  • Disabled person: means a person in a disabled condition. See Louisiana Revised Statutes 40:1300.32
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Eligible medical condition: means Crohn's disease, ulcerative colitis, inflammatory bowel disease, irritable bowel disease, or any other medical condition that requires the use of an ostomy device or immediate access to a restroom. See Louisiana Revised Statutes 40:1300.42
  • Emergency symbol: means the caduceus inscribed within a six-barred cross used by the American medical association to denote emergency information. See Louisiana Revised Statutes 40:1300.32
  • Ex officio: Literally, by virtue of one's office.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Fraud: Intentional deception resulting in injury to another.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Identifying device: means an identifying bracelet, necklace, metal tag, or similar device bearing the emergency symbol and the information needed in an emergency. See Louisiana Revised Statutes 40:1300.32
  • Law enforcement officer: means a person authorized to make arrests for violations of any laws. See Louisiana Revised Statutes 40:1300.32
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Local government: means a parish or municipality, as provided pursuant to Article VI, Sections 1 and 2 of the Constitution of Louisiana. See Louisiana Revised Statutes 40:1300.62
  • Medical practitioner: means a person licensed or authorized to practice medicine pursuant to Sections 1261 through 1290 of Title 37 of the Louisiana Revised Statutes. See Louisiana Revised Statutes 40:1300.32
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Office: means the state office of rural development created by this Chapter. See Louisiana Revised Statutes 3:313
  • Official forecast: means the most recently adopted estimate of money available for appropriation by the Revenue Estimating Conference as provided in Louisiana Revised Statutes 39:2
  • Ostomy device: means a medical device that creates an artificial passage for elimination of body waste. See Louisiana Revised Statutes 40:1300.42
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means an individual or any legal or commercial entity, including a corporation, business trust, partnership, limited liability company, association, or joint venture. See Louisiana Revised Statutes 3:1
  • Political subdivision: means a parish, municipality, and any other unit of local government, including a school board and a special district, authorized by law to perform governmental functions. See Louisiana Revised Statutes 3:313
  • Program: means a grouping of activities directed toward the accomplishment of a clearly defined objective or set of objectives. See Louisiana Revised Statutes 39:2
  • Quorum: The number of legislators that must be present to do business.
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Retail establishment: means any business whether a sole proprietorship, corporation, partnership, or otherwise that holds or stores articles, products, commodities, items, or components for sale to the public or to other retail establishments. See Louisiana Revised Statutes 40:1300.42
