Terms Used In Maine Revised Statutes > Title 10 > Part 3 > Chapter 203-A - Manufacturer Warranties On Motor Vehicles

  • Amusement ride: means a device or combination of devices or elements that carry, convey or direct a person over or through a fixed or restricted course or within a defined area for the primary purpose of amusement or entertainment. See Maine Revised Statutes Title 8 Sec. 471
  • Amusement ride inspector: means an amusement ride inspector employed by the Office of the State Fire Marshal. See Maine Revised Statutes Title 8 Sec. 471
  • Amusement show: includes but is not limited to a carnival, thrill show, ice show and rodeo. See Maine Revised Statutes Title 8 Sec. 471
  • ASTM standards: means standards for amusement rides established by American Society for Testing and Materials International or a successor organization and adopted by the commissioner by rule. See Maine Revised Statutes Title 8 Sec. 471
  • Board of directors: means the governing body with statutory powers and duties for a school administrative district. See Maine Revised Statutes Title 20-A Sec. 1
  • Commissioner: means the Commissioner of Public Safety. See Maine Revised Statutes Title 8 Sec. 471
  • Commissioner: means the Commissioner of Education or the commissioner's designee. See Maine Revised Statutes Title 20-A Sec. 1
  • Consumer: means the purchaser, other than for purposes of resale, or the lessee, of a motor vehicle, any person to whom the motor vehicle is transferred during the duration of an express warranty applicable to the motor vehicle and any other person entitled by the terms of the warranty to enforce the obligations of the warranty, except that the term "consumer" shall not include any governmental entity, or any business or commercial enterprise which registers 3 or more motor vehicles.   • Department: means the Department of Education. See Maine Revised Statutes Title 20-A Sec. 1
  • Manufacturer: means manufacturer, importer, distributor or anyone who is named as the warrantor on an express written warranty on a motor vehicle. See Maine Revised Statutes Title 10 Sec. 1161
  • Motor vehicle: means any motor driven vehicle, designed for the conveyance of passengers or property on the public highways that is sold or leased in this State, except that the term "motor vehicle" does not include any vehicle used primarily for commercial purposes with a gross vehicle weight of 8,500 pounds or more. See Maine Revised Statutes Title 10 Sec. 1161
  • Operator: means an individual having direct control of the starting, stopping or speed of an amusement ride. See Maine Revised Statutes Title 8 Sec. 471
  • Owner: means a person who owns or leases or manages the operation of an amusement ride. See Maine Revised Statutes Title 8 Sec. 471
  • Private school: means an academy, seminary, institute or other private corporation or body formed for educational purposes covering kindergarten through grade 12 or any portion thereof. See Maine Revised Statutes Title 20-A Sec. 1
  • Private school approved for tuition purposes: means a private school approved for the receipt of public funds under sections 2951 to 2955. See Maine Revised Statutes Title 20-A Sec. 1
  • Reasonable allowance for use: means an amount that can not exceed the lesser of 1/3 of that amount allowed per mile by the United States Internal Revenue Service as provided by regulation, revenue procedure or revenue ruling promulgated under the United States Internal Revenue Code, Title 26, Section 162 for the use of a personal vehicle for business purposes based upon the mileage reported for that motor vehicle on the application for state-certified arbitration accepted by the State plus all mileage directly attributable to use by a consumer beyond 20,000 miles or 10% of the purchase price of the vehicle.   • Rider: includes a customer of an amusement ride who is waiting in the vicinity to get on the amusement ride and a departing customer who is still in the vicinity of the amusement ride. See Maine Revised Statutes Title 8 Sec. 471
  • School administrative unit: means the state-approved unit of school administration and includes a municipal school unit, school administrative district, community school district, regional school unit or any other municipal or quasi-municipal corporation responsible for operating or constructing public schools, except that it does not include a career and technical education region. See Maine Revised Statutes Title 20-A Sec. 1
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • State board: means the State Board of Education. See Maine Revised Statutes Title 20-A Sec. 1
  • State-certified arbitration: means the informal dispute settlement procedure administered by the Department of the Attorney General which arbitrates consumer complaints dealing with new motor vehicles that may be so defective as to qualify for equitable relief under the Maine lemon laws. See Maine Revised Statutes Title 10 Sec. 1161
