Terms Used In Maine Revised Statutes Title 22 Sec. 3765
- Department: means the Department of Health and Human Services. See Maine Revised Statutes Title 22 Sec. 1-A
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Probate: Proving a will
When a relative with whom a child is living is found by the department to be incapable of taking care of the child’s money, payment may be made only to a legally appointed guardian or conservator and, notwithstanding Title 18?C, Article 5, Part 4, in the matter of infirmities of age or physical disability to manage the child’s estate with prudence and understanding, the Probate Court may appoint any suitable person as a conservator.
