Terms Used In Maine Revised Statutes Title 38 Sec. 570-F

  • Heavy oil: means forms of oil that must be heated during storage, including, but not limited to, #5 and #6 oils. See Maine Revised Statutes Title 38 Sec. 562-A
  • Oil: means oil, oil additives, petroleum products and their by-products of any kind and in any form, including, but not limited to, petroleum, fuel oil, sludge, oil refuse, oil mixed with other nonhazardous waste, crude oils and all other liquid hydrocarbons regardless of specific gravity. See Maine Revised Statutes Title 38 Sec. 562-A
  • Structure: means anything temporarily or permanently located, built, constructed or erected for the support, shelter or enclosure of persons, animals, goods or property of any kind and anything constructed or erected on or in the ground. See Maine Revised Statutes Title 38 Sec. 436-A
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 1 Sec. 72
2. Other structure. As an oil-water separator, catch basin, flood drain or other emergency containment structure as long as the structure:
A. Is used to collect, capture or treat storm water surface runoff or oil spills; [PL 2017, c. 333, §10 (AMD).]
B. Is not used for the storage of oil; and [PL 2017, c. 333, §10 (AMD).]
C. Is regulated under the federal Clean Water Act, 33 United States Code § 1317(b) or Section 1342. [PL 2017, c. 333, §10 (NEW).]

The department shall adopt rules for underground oil storage facilities for storing waste oil. The department shall also adopt rules governing field-constructed, airport hydrant and heavy oil underground oil storage facilities. These rules are not limited by other provisions of this subchapter. [PL 2017, c. 333, §10 (AMD).]
