Terms Used In Maine Revised Statutes > Title 9-B > Part 10 > Chapter 105 - Mutual Holding Company

  • Agency: means a branch office of a financial institution at which all or part of the business of the institution is conducted, but the records pertaining to such business are maintained at another office of the institution, and not at such agency office. See Maine Revised Statutes Title 9-B Sec. 131
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Application: means a request under the Convention by an obligee or obligor, or on behalf of a child, made through a central authority for assistance from another central authority. See Maine Revised Statutes Title 19-A Sec. 3311
  • capital: means the sum of common stock, paid-in common stock surplus, perpetual preferred stock, undivided profits and other capital reserves; [PL 1997, c. See Maine Revised Statutes Title 9-B Sec. 131
  • Central authority: means the entity designated by the United States or a foreign country described in section 2802, subsection 3?A to perform the functions specified in the Convention. See Maine Revised Statutes Title 19-A Sec. 3311
  • Child: means an individual, whether over or under the age of majority, who is or is alleged to be owed a duty of support by the individual's parent or who is or is alleged to be the beneficiary of a support order directed to the parent. See Maine Revised Statutes Title 19-A Sec. 2802
  • Child support: means money paid directly to a parent, to another person or agency awarded parental rights and responsibilities with respect to a child or to the department on behalf of a child receiving public assistance and medical or dental insurance coverage provided on behalf of a child pursuant to court order. See Maine Revised Statutes Title 19-A Sec. 1501
  • Convention: means the Convention on the International Recovery of Child Support and Other Forms of Family Maintenance concluded at The Hague on November 23, 2007. See Maine Revised Statutes Title 19-A Sec. 2802
  • Department: means the Department of Health and Human Services and its agents and authorized representatives. See Maine Revised Statutes Title 19-A Sec. 101
  • Direct request: means a petition filed by an individual in a tribunal of this State in a proceeding involving an obligee, obligor or child residing outside the United States. See Maine Revised Statutes Title 19-A Sec. 3311
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Federal association: means a savings and loan association, savings bank or other financial institution organized pursuant to the Act of Congress entitled "Home Owners' Loan Act of 1933" as amended, or any subsequent Act of Congress relating thereto. See Maine Revised Statutes Title 9-B Sec. 131
  • Financial institution: means a universal bank or limited purpose bank organized under the provisions of this Title, and a trust company, nondepository trust company, savings bank, industrial bank or savings and loan association organized under the prior laws of this State. See Maine Revised Statutes Title 9-B Sec. 131
  • Financial institution holding company: means any company which is deemed to be a holding company pursuant to the provisions contained in chapter 101. See Maine Revised Statutes Title 9-B Sec. 131
  • Foreign central authority: means the entity designated by a foreign country as defined in section 2802, subsection 3-A to perform the functions specified in the Convention. See Maine Revised Statutes Title 19-A Sec. 3311
  • Foreign country: means a country, including a political subdivision thereof, other than the United States, that under its law authorizes the issuance of support orders and:

  • Foreign support agreement: includes a maintenance arrangement or authentic instrument under the Convention. See Maine Revised Statutes Title 19-A Sec. 3311
  • Foreign support order: means a support order issued by a foreign tribunal. See Maine Revised Statutes Title 19-A Sec. 2802
  • Foreign tribunal: includes a competent authority under the Convention. See Maine Revised Statutes Title 19-A Sec. 2802
  • Income: includes earnings or other periodic entitlements to money from any source and any other property subject to withholding for support under the law of this State. See Maine Revised Statutes Title 19-A Sec. 2802
  • Income-withholding order: means an order or other legal process directed to an obligor's employer, as provided by chapter 65, subchapter IV, to withhold support from the income of the obligor. See Maine Revised Statutes Title 19-A Sec. 2802
  • Law: includes decisional and statutory law and rules and regulations having the force of law. See Maine Revised Statutes Title 19-A Sec. 2802
  • Mutual financial institution: means any institution as defined in section 131, subsection 27. See Maine Revised Statutes Title 9-B Sec. 1052
  • Mutual holding company: means any corporation organized pursuant to this chapter. See Maine Revised Statutes Title 9-B Sec. 1052
  • Obligee: means :

  • Obligor: means an individual or the estate of a decedent:

  • Person: means an individual; corporation; business trust; estate; trust; partnership; limited liability company; association; joint venture; public corporation; government or governmental subdivision, agency or instrumentality; or any other legal or commercial entity.   • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Maine Revised Statutes Title 19-A Sec. 2802
  • Register: means to file in a tribunal of this State a support order or judgment determining parentage of a child issued in another state or foreign country. See Maine Revised Statutes Title 19-A Sec. 2802
  • state: includes an Indian nation or tribe. See Maine Revised Statutes Title 19-A Sec. 2802
  • Subsidiary: means a corporation, partnership, business trust, association or similar organization, all of which are referred to in this subsection as "another company" owned or controlled by a financial institution or financial institution holding company. See Maine Revised Statutes Title 9-B Sec. 131
  • Subsidiary universal bank: means any universal bank organized under the laws of this State, at least 51% of the voting stock of which is wholly owned by a mutual holding company. See Maine Revised Statutes Title 9-B Sec. 1052
  • Superintendent: means the Superintendent of Financial Institutions. See Maine Revised Statutes Title 9-B Sec. 131
  • Support enforcement agency: means a public official or agency authorized to:

  • Support order: means a judgment, decree, order, decision or directive, whether temporary, final or subject to modification, issued in a state or foreign country for the benefit of a child, a spouse or a former spouse, that provides for monetary support, health care, arrearages, retroactive support or reimbursement for financial assistance provided to an individual obligee in place of child support.   • Tribunal: means a court, administrative agency or quasi-judicial entity authorized to establish, enforce or modify support orders or to determine parentage. See Maine Revised Statutes Title 19-A Sec. 2802
  • tribunal of this State: means the District Court or the Department of Health and Human Services. See Maine Revised Statutes Title 19-A Sec. 2802
  • United States central authority: means the Secretary of the United States Department of Health and Human Services. See Maine Revised Statutes Title 19-A Sec. 3311
  • Universal bank: means an investor-owned institution or a mutual financial institution authorized by its organizational documents to exercise all the powers granted in Part 4 and includes a trust company, a savings bank and a savings and loan association chartered by special act of the Legislature, established prior to October 1, 1975 or established pursuant to this Title.
