Terms Used In Maryland Code, LOCAL GOVERNMENT 11-210

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
(a) A defendant who is found guilty of a civil infraction may file a motion for a new trial or a motion for a revision of judgment as provided by law for a criminal case.

(b) (1) A motion filed under this section shall be filed in the same manner as a motion filed in a criminal case.

(2) In ruling on a motion filed under this section, the court has the same authority that the court has in a criminal case.
