Massachusetts General Laws ch. 164 sec. 75H – Licenses, permits, etc., for pipeline maintenance, construction and operation
Section 75H. A person, partnership, corporation or any other legal entity which intends to construct a natural gas pipeline within this state and has filed for a certificate of public convenience and necessity to be issued under chapter 15B of the United States Code which may be cited as the federal ”Natural Gas Act” or has filed a petition with the department as provided in section seventy-five B, shall be deemed to have such right, title, interest or standing to proceed to file and process any application for any permit, license, approval, order of any nature or description, of any state or local agency or instrumentality, necessary to obtain all governmental consents with regard to the location, construction, completion and operation of said pipeline within the state and shall be deemed to be a natural gas pipeline company for said purpose. The effective date of any such license, permit, order or governmental approval which may be granted or issued may be conditioned upon or suspended until the date of issuance of such certificate under chapter 15B of the United States Code which may be cited as the federal ”Natural Gas Act” or determination by the department.
