Section 24U. (a)(1) Whoever knowingly breathes into a certified ignition interlock device as defined in section 24T or starts a motor vehicle equipped with such a device for the purpose of providing an operable motor vehicle to a person whose license or right to operate a vehicle is restricted to the operation of vehicles equipped with a certified ignition interlock device shall be punished by a fine not less than $1,000 nor more than $5,000 or imprisonment in a house of correction for not less than 6 months nor more than 21/2 years in the house of correction and, for a second or subsequent conviction, by imprisonment in a state prison for not less than 3 nor more than 5 years.

(2) A certified copy of an acknowledgement of the existence and terms of certified ignition interlock device restriction, executed by a person alleged to have violated this section shall be admissible as evidence to prove the existence of such knowledge by the person who executed the document.
