A person shall not transport or require, permit, or knowingly allow to be transported a hazardous material for which a placard is required under 49 C.F.R. § part parts 100 to 199 in a commercial motor vehicle if the operator of the vehicle does not have a hazardous material endorsement on his or her operator’s or chauffeur’s license. A person who violates this section is guilty of a misdemeanor punishable by imprisonment for not more than 1 year or a fine of not more than $500.00, or both.
