Terms Used In Michigan Laws 28.838

  • Child: means an individual who is less than 18 years of age and is not emancipated by operation of law as provided in section 4 of 1968 PA 293, MCL 722. See Michigan Laws 28.832
  • Criminal history record information: means that term as defined in section 1a of 1925 PA 289, MCL 28. See Michigan Laws 28.832
  • Department: means the department of state police. See Michigan Laws 28.832
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
    The department may charge a fee for a national and state criminal history record information conducted under this act that does not exceed the actual and reasonable cost of conducting the check, plus the amount prescribed by the Federal Bureau of Investigation for the national criminal history record information in compliance with the national child protection act of 1993, 34 USC 40101 to 40104.
