(1) A person subject to this code and charged with an offense under this code shall be ordered into arrest or confinement, as circumstances may require. If the person is charged only with an offense normally tried by a summary court-martial, the person shall not ordinarily be placed in confinement.
(2) An arrest or confinement of a person who fails or refuses to report to his or her appointed place of duty shall be executed pursuant to a warrant issued by the convening authority in a form approved by the adjutant general.
Terms Used In Michigan Laws 32.1010
- Arrest: Taking physical custody of a person by lawful authority.
- Commanding officer: includes only a commissioned officer. See Michigan Laws 32.1002
- Confinement: means the physical restraint of a person. See Michigan Laws 32.1002
- Military: includes each armed force of the United States and each component of the state military establishment. See Michigan Laws 32.1002
- person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l
- state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
- State military forces: means the national guard of the state, as defined in 32 USC 101(3), and any other military force organized under the laws of the state. See Michigan Laws 32.1002
- Unit: means a regularly organized body of the military that is not larger than a company or squadron. See Michigan Laws 32.1002
(3) A warrant of arrest shall be served by a person authorized to serve a warrant of arrest in this state or by military personnel designated for that purpose by the commanding officer.
(4) A person confined pursuant to this code shall be confined in a place of confinement under the control of the state military forces or in a jail in the county in which the accused resides or in which the person’s unit is located.
